Companies must take some responsibility for shouldering the effects of fraud. If fraud is rife that merely suggest that their procedures are too lax. If all you have to do to open a credit account is tick a frigging box on the internet then they must accept that, in some cases, it ain't gonna be the real person ticking that box.

Do not accept that this is your problem, mandooz. You are the injured party here, and Littlewoods and your daughter's ex must shoulder the blame, not your daughter. But some more details would be useful. Was a card used? Whose card was it?

  • thanks for all advice.
The bill is £520 - 200 for phone plus £320+ in charges
The phone and 2 bills were apparently delivered to our house but he helped himself while I was out.
I do not think any card was assigned (mainly because my daughter does not have any). According to Littlewoods 2 payments of a few pounds were made in cash.
I am very 2 minded about this and my normal instinct is to just pay and let it go partic if it was actually also used by my daughter(see sky bills etc).
But I genuinely feel that Littlewoods have a responsibility to do some security checks or are they just desperate for any business?
I suppose what I am really asking is do they have an agreement with her if she has not signed anything?

Nowadays online agreements can be 'digitally signed' by ticking a box. Get the fraud team on to him asap. That's definitely what I'd do.

You can't make cash payments to Littlewoods?

It's usually a DD that they set up, but it is possible to skip this and enter your card details each month to make a payment.

The first item ordered, and anything they deem high risk, has to be delivered to the registered address - so if your daughter is on the electoral roll at her house, and he registered the account at her house, the phone and statements would be delivered there.

Littlewoods are usually very helpful, though, so phone up and explain that you had no idea it was open.

I'm with fridaycat on this one,how did neither you nor your daughter notice when the phone was delivered to your home, presumably the boyfriend wasn't allowed there on his own.
I would certainly contact Littlewoods fraud dept.
How come the charges are £320? a late payment fee of £12 is applied for missed/late payments this must have been going on for some time.

Elle7 cash payments can be made via paypoint or post office
  • yes I believe that the payments were made in cash at a post office.
Our post is left in the hall and anyone in the house has access to it, and yes he was here when I may have gone into the garden or something. I think you will just have to take my word for it that we knew nothing about it!!
I am not sure how the fees are £320 they added insurance and i think multiples of £12 - late payments, and letters.
I would add that since they split up (6 months) we have had no further letters except the 2 latest that prompted my daughter to ask for copy of credit agreement.
My daughter is not registered on the electoral role at my address.
I really am beginning to think that Littlewoods are quite negligent.
I will however suggest that my daughter phone again and try to explain and then contact the police.

Sorry to bang on about this, but an item such as a phone would have to be signed for, the delivery driver would not just "leave it in the hall". So who actually signed for it?? Or did the BF do this while you (and presumably everyone else in the household) were out in the garden? If so, he has an excellent knack of timing for getting post with no-one seeing it, and also delivery parcels. If you don't know who signed, LW should be able to get a copy of the signature from the delivery driver's hand held terminal which your daughter will be able to request.

Sorry OP - but I'm not buying it. OK, I believe you when you say you knew nothing about it. But a little voice inside me says that possibly your daughter did? :o In which case, it would be hard to argue that the account was opened fraudulently.

If the phone was delivered to your address and they have a signature, I think you would have trouble convincing anybody this is fraud tbh.

Are you sure your GF didn't agree to it and now its all over she realises she has made a big mistake and trying to find a way out?

If this genuinely was fraud though, do not pay it like advised!

Don't bang on about it then, just accept what the OP has said. The phone would have been next day delivery and he could have picked a day when everyone was out, It just doesn't matter.

I'll bang on about whatever I want, thanks very much! Who are you to say what I can and can't post

And is it likely that the BF who the OP disliked by the sound of it, is going to allow to be inside HER house on his own??

I am just showing another side of the story and pointing out that perhaps there is more to this than a fraudulent account. So it potentially COULD matter.
