OK to sell 'free' upgrade mobile on contract?

Hi,
An elderly relative of mine has just received a free upgrade phone as part of her contract with Orange. She has given it a go, but prefers her old one. If she continues to pay the bills (which she does of course) and pops the SIM in her old phone, can she sell off the free upgrade while it's still a popular and current model?
I have had a number of mixed responses from people and wondered if anyone knew exactly!

Yup she can sell it no problem, its hers to do with as she wishes. It's not rented like a broadband router from you ISP, it is subsidised within the tariff cost (that's why the more expensive your tariff is the cheaper the phone is/better phone you can get).0

yes as its hers to sell the minute it arrivesDon't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0

Just a follow up to this question - which SIM card should be sold on? I mean, the SIM card in the NEW phone will be unactivated, can the buyer of the new phone activate the SIM under the elderly relatives name?
So should the seller, just continue using their Original SIM as normal and sell on the NEW PHONE WITH THE NEW SIM making no special arrangements, or should they take the NEW SIM from the NEW PHONE and register it on the OLD PHONE?
I'm going to be in the same situation this weekend so was hoping someone could give decisive answer

I am pretty sure that the new sim will be the same number as the original. Buyer should get their own sim and probably on the same network.

Your relative must use the new sim as that is part of her contract, and the person who purchases the handset will make their own arrangements for a sim.
If you give them the sim as well as the phone they will be running a bill up for you and you will be liable for the bill no matter how big it is, you must keep the new sim card

Sell it without a sim card. With it there is a risk the buyer may get into her account or use her minutes.0 -
And if you are selling on Ebay, then no overseas buyers, UK only with PayPal who have a good cedit rating.
If with a buyer like Mazuma or Environfone, do some reading up and go for a reliable one that won't do you, taking a few pictures of the handset first in case they claim any damage or scratches. Personally I used Mazuma with no bother - others may recommend an alternative.0 -

Remember she's paying for it with her contract instalments. If she hadnt accepted the "free" phone she could have been paying much less per month...0
