I have today received my third letter from these BULLIES from Excel parking who are now threatening me with Bailiffs and possible court action. I am now in the process of making an appointment with my MP. I nearly gave in and paid until I read this Blog and now am more determined not to pay this man called Simon Renshaw-Smith who owns the company. I have read the Mail online article dated 22nd March 2008 whereby he had taken a woman to court and the judge quashed the case stating that it set out to 'frighten & intimidate' apparently this so called fine is 'unenforceable'.
So guys do i continue to ignore them and state the 'debt is denied' ?
I do need some reassurance as I feel uneasy about bailiffs !!!!

Of course before real bailiffs come on to the scene the case has to go to court, you lose and then you refuse to pay whatever the judge orders. This is such a remote possibility (especially with Excel) it's not worth worrying about.

Please don't confuse bailiffs with debt collectors who are just private individuals with no more power than you or I to demand money off people. In short just ignore these bullies. If you stand up to them they will back down and try and con some other "victim".
What part of "A whop bop-a-lu a whop bam boo" don't you understand?
  • Firstly to Rcooky, you use the word harassment frequently, you are also with baby and therefore in no position to deal with extra stress. Most of us regulars here don't care whether we get tickets from private companies or not, and we ALL know Graham White. None of us loses sleep! My point is this, you have the actual losses argument in the bag should this ever go to court and that alone is enought to see you victorious. However, if you are ex-directory then it is for a reason that you are, and if you are honestly tormented by these rats' approach then I strongly suggest you report it to the police. Harassment is a criminal offence. Let me assure you however, there is NOTHING they can do to you - not because they don't go that last mile but because their demand is illegal.

Vicky - I wouldn't waste time talking to any elected mongrels. We see them haranguing from soapboxes on their meet-the-people campaigns ahead of elections and then they fade into oblivion. Just send all letters you identify as coming from the nexus back in the post and mark them "refused". They'll go away, I assure you.
  • I am also ex-directory and receive about 15 calls from unwanted callers. It is very useful to have caller display, therefore I only answer to friends. If it's anyone genuine they can leave a message..but none of these withheld numbers or others ever do.
If I accidentally answer I always say I'm the cleaner...do you want to leave a message? and again they never do.
It is worrying they can aquire ex directory numbers' and you wonder what other information they have access to!
Having had the same three letters as you I feel I will have to open the next and wonder whether it could still be returned maked "denied".

No-one here suggests replying to any of the scam letters. Just ignore them.

But as for phone calls - the opposite is true. Answer the call, confirm you are the person they want (registered keeper of the car) then tell them the debt is denied and to cease all contact immediately, either as Roxburghe or when passing themselves off as Graham White. Tell them to return the file to the originator or risk ANOTHER report about their conduct to the Office of Fair Trading, and a Court case for harassment.

Talk over them to make these points clear and use the words 'the debt is DENIED'. No discussion, phone down.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
