Help - Trying to get a refund for my sons broken Buzz Lightyear and they are refusing

Hi everyone
I purchased a buzz lightyear interactive toy for around £40 from Tescos for my son for Christmas 2010.
He only played with it a few times, but now his leg has fallen off and various other parts. Its too late to return it to the shop and I dont have proof of purchase. So, I emailed the manufacturer. They have offered to send buzz a new leg, but I have asked them for a refund or an alternative toy. I am worried that the toy is not safe if it breaks so easily - swallowing hazzard etc etc.
Ive explained that my son is very careful with his toys and none of his other toys have broken in the past.
Ive received an email back saying
'I am sorry we are unable to offer you a refund or an alternative toy. This toy is not defective, it broke after it was dropped. Buzz has multiple joints of articulation that makes it highly poseable and it is understandable that such joints are susceptable to breakage when dropped. This toy is recommended to ages 4+'
How can you tell a child not to drop his toy?!!
Any help very gratefully received. I feel sorry for my little son with his broken toy

I'd go back to Tesco, buy another one - keep the receipt - wait two weeks and then take the broken one back and get a refund! I know this is going to upset a few people but it isn't your fault. I would still have hassled Tesco but if you've no receipt your not going to get anywhere so this is the way around their no receipt no return policy.
I keep a wee box and try to put every receipt I get for stuff for my kids as shops have tightened up their return policies.
A toy should last longer - yes Buzz Lightyear is posable - but £40 is alot!0 -
Good plan about getting a new one, but the problem is - I think I would rather have my money back or exchange it for a woody who is less likely to break? I love toy story but buzz is such a rubbish toy if it breaks when you drop it grr! Any other ideas?0

Yay! fraud! (You didn't upset me, but If I followed your advice and got caught could I get the police to come round and arrest you instead?- would not recommend the OP follow this posters advice to buy another and swap it.
You wont get your money back, they have fulfilled more than their legal obligation (after 6 months its up to you to prove it was defective from source with a specialist report) as it stands they offered you a replacement, one of three options they can choose, which is their choice.0 -
You have no right to your money back.
Accept the replacement, and if that develops the same fault, THEN look at demanding a refund or alternative.Should've = Should HAVE (not 'of')

Just vaccept that the kid plays with his toy's and that when they drop them they break, take it out his pocket money.0

well its lasted 8 months, which i would say is good going.
i would love to know the statistics of how many toys given on Christmas day never make it to Boxing day0 -
Boxing day - national refund day! Was one of my favourite days to work when I worked at Argos:beer: Been smoke free for 4 years!! :beer:0

When I was a kid, if I broke a toy, even if I was 4, my parents didn't let me have another, they told me that it was my fault and if I can't look after my toys I won't have any toys.
When my brother was 10 (I'm 5 years younger than him) he used to be really rough with his toys, and I rescued a bunch of them and he wasn't too bothered because he was growing out of them anyway (so he said).
It was a bunch of what became really rare transformers. I had them up until august last year, when I sold the collection on ebay for a few thousand pounds.
Moral of this story: Don't blame tesco for your child's clumsiness, instead, teach your child to be more careful with his toys, and he'll make a tidy ebay profit in twenty years :P0 -
We too bought the Buzz Lightyear for my little boy and Buzz's wing broke about 2 days after him receiving it, I took it back and they swapped it no problem, the new Buzz broke about 4 months later and typically I couldn't find my receipt, I took it back and explained the problem, they once again replaced it as apparently the Buzz I'd bought was only available in Tesco.0

When Buzz fell in the film, his limb came off. Seems like quite a realistic toy to me.One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.0
