    Also the police filed a report at the scene of the accident and I have photocopies of the third-parties Insurance Documents and Driving License, so i'm fairly certain he was insured at the time of the incident.

    I dont think anyone here is getting carried away with the issue of fronting - the suspicion of fronting is the obvious reason for Avivas behaviour.
    That the OP has not replied causes me to wonder if it has suddenly dawned on them.

    Or perhaps because some people aren't being too helpful and are making wild accusations.

    or perhaps people who know what they are talking about are trying to help by identifying the likely reasons for what has happened. The posts have made it clear that it looks like fronting but not enough is known. They are not accusations. They are suggestions to what the issue may be and to give further info so it can be confirmed or not.
    The main policy holder is the MAIN driver of the car and has gone away on a family emergency!

    There is no such thing as a main policyholder. There is the policyholder. Main refers to the driver.

    Your comment suggests they are going to be away for the short term.... a few weeks maybe? However, your other points suggest this has already been going on at least 5 weeks. How long are they going to be away?

    Without intending to hijack the OP's thread - and its good to see they've come back and responded - how much can someone drive someone elses car as a named driver before it becomes fronting? Does anyone know? When I was a named driver on fathers car I drove it maybe 5-6 times a year, when he was unable to drive back from somewhere or it needed to go to the garage. When I had someone as a named driver on my policy for just a few weeks in case they needed to drive my car briefly it brought the policy price down! This was some time ago mind you

    It's a good question.
    As thenudeone said, they may not even have driven it all on the policy this year.

    How do you work out the main driver.
    Annual mileage?
    Amount of time in the car?
    Does it change week on week?

    (Take my daughter's car, I don't drive it at all normally, but I'm a named driver. She plans to leave it in the garage in term time now, so if I start it once a week, and run it arond the block for a mile or wo, am I the main driver, until christmas when she'll be home and put a few hundred miles on it again?)

  • The policyholder is the MAIN driver! The policyholder was present when the Claim was submitted! The point is, we called AVIVA a week after car when in for repairs, the estimate was sent to AVIVA and they had APPROVED the claim! 4 Weeks have passed, and we have assumed the car is being repaired as NOBODY has called us to tell us the claim has been pending! We received a call 4 weeks later from DRIVE ASSIST saying the Courtesy Car needs to be returned because AVIVA have had the claim PENDING... without telling us!

    They wanted to talk to the policyholder which was fine, policyholder passed all the relevant security checks, however the individual from AVIVA was not convinced that the policyholder were who they say they were hence now they want a face-to-face interview which is not possible because the policyholder is abroad.

    What I don't understand is, why did they APPROVE the claim initially, and then put it on pending for three-four weeks without telling us... I've only found out because Drive Assist wanted their car.

    Anyhow, AVIVA have been absolutely useless and incompetent, I have filed a claim directly with MIB and the UK Claims representative for the third-party in the UK who have been helpful so far.

    They have stated to me, once the third-party have stated the driver was covered at the time of the incident, it will be fairly straight forward because he under the influence of alcohol and the police report confirms this!

    Why AVIVA have failed to see this and have been absolutely shocking in their communication is beyond me.

    You have found out about Aviva as many do - the hard way!

    Do a search (here and across the net) to see what others think of their so called "service".
  • The way which I've been kept out of the loop and lack of communication has been horrendous!

    What is the point of insurance? If the third-party do not payout, I'm facing a huge bill for something which is totally NON-FAULT!

    I will be pursuing this with the relevant insurance bodies because why was the claim approved and then pending, which was held for 4 weeks without my knowledge!

    We no longer have a car because Drive Assist have taken it away, so what's the point of having courtesy car cover!

    AVIVA have truly shafted me!

    How have they shafted you? You are not the policyholder.

    This may be why Aviva are on guard. You are wording it as if you are the person responsible for the car.
