Clamped by the council - worth appealing?

    Whoever contracted the clampers, it may not be the landowner and often is not.

    Your OH should post on pepipoo forums for help to sue the clampers and whoever contracted them (named as jointly/severally liable) for a full refund.

    Almost no private clamping is within current law, they are thick-necked and thick-brained thugs in general who cannot create a proper contract on a sign, or draw up a proper receipt in a million years. And for the few that manage to get the signage & paperwork right, they are usually caught out by their own greed, when the high amount of the clamp release fee makes it an obvious and unlawful penalty clause.

    Making a small claim aginst clampers and whoever let them infest the car park, costs about £30ish with no need for a solicitor. Help is available for free on pepipoo forums.

  • Thanks all for the help, I'll appeal and let you know how I get on.
    Re asking the landlord - there are parking bays all around the flats (council) but the markings are all rubbed and I couldn't fathom who's was whose.
    I did leave a note in the car saying which flat we were in however I suppose its to much on an old fashioned thing to walk a few paces and tell someone they need a permit. That and the landlord should have known we need a permit.

    Have you posted on pepipoo yet? Please don't waste your appeal by not getting the free help that's out there.

    In fact if it's a 'parking charge notice' then it's the Council acting like a private parking company so an appeal would not be the right approach. Do post on the correct pepipoo forum if you have not done so already, this is a little complicated as it was not 'on-street'.
