Clamped by the council - worth appealing?

I wonder if I have grounds for appealing for being clamped by the council? In was outside my daughters flat, a privately rented ex LHA. Her landlord said there was no problem in parking however we now realise we should have had a permit.
The grounds for appeal would be -
The road markings have worn away by about 95%, so the place just looked like waste land.
The vehicle registration was wrong.
I've got the photos and the notice - is it worth trying to get the £110 back?
Thanks.

  • Get further details as its not common for councils to clamp, tow yes. I bet its a private clamper.

  • It was Southwark council - the van was marked with their logo. Thanks for the quick response.

A Council acting as a private parking company then? Possibly? If you are not sure can you post a pic of the paperwork here please and we should be able to tell.

One for pepipoo to help with but get the right part of the forum please:

Post here if it's a Council 'Penalty Charge Notice' and tow, issued on public highway:

    http://forums.pepipoo.com/index.php?showforum=30

But post here on a different pepipoo forum if it was a 'Parking Charge Notice' with clamp then tow (a Council pretending it was a real PCN):

    http://forums.pepipoo.com/index.php?showforum=60

If it's the latter please make it clear in your new topic title that it's a Council 'acting as a PPC' so they don't move the thread back!

And why on earth would anyone NOT appeal a clamp/tow after paying the money out, there's no risk as you have already paid! Everything to play for.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Also, did the landlord have any authority to say it was OK to park there?
  • If OP gets to pepipoo they will ask him/her to check what the lease says. Permission on her lease regarding parking carries more weight than made up regs.

Can i just ask, is private clamping illegal now?

I'm asking as OH got clamped a few months ago, and paid for them to come out and it most certainly was not the local council.

And just so i know what to do if it ever happens to me, what do i do if it is illegal...

Do you have a blue badge, Mupette? If so, just make sure you always display it. They're not allowed to clamp a car displaying a blue badge. If they do clamp you illegally, call the police, and don't take "it's a civil matter" for an answer.

Not yet it is on its slow march through Parliament.

What where the circumstances of your car being clamped? if it wasn't lawful, [most are not] you could issue a claim to get your money back. From the clampers and the landowners! You have six years to lodge a claim!
