I guess it depends on how you look at it - if you want to just "get shot" of it and put it all behind you .... (and at least your credit file hasn't been damaged) then I guess you could pay .... but it's still not right and you shouldn't have to as a fraud would appear to have been committed and as others have said it should now be voided.
i know, and thats exactly what i said!! im just so fed up with it tbh, i have no choice but to pay - and im just about to it as i refuse to pay any interest on this! its not affected my rating thankfully but hopefully when they get the ccj it will affect theirs! set of sh*t bags that they are :mad:0 -

the question you want to ask them is if the account has never gone into default then why are they pursuing you for payment. Second question you need to ask them is that by accepting a change of details from your contact deems the contract unenforcable as they have allowed a 3rd party to act on your behalf without your prior permission. Stick to your guns.0 -

You are confusing 'going into default' with being issued a default notice - whilst connected are two seperate things - confusing I know !
Any account where payments are missed is in effect 'in default'. This is different to a 'default notice' being issued by the lender.0 -
yea i think your right Hanky Panky, they pursue me when a payment is late or been missed which i suppose is their right as i stupidly signed as guarentor. Think the only thing they have actually done wrong is allow her to change my details..... im just gonna have to pay it, then work loads of overtime to pay my card off - least its a 0% credit card :0)

Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
If you are planning to upsize the new house will cost more.
If you are planning to downsize your new house will cost more than it should
If you are trying to buy your first house its almost impossible.0 -

If you are going to use bailiffs i suggest you transfer it up to High Court Enforcement officers (HCE)
the more info you can give them the better address,place of employment car make model colour and registration (fingers x that its a high vale car and not on HP)
HCE will cost you (don't know how much but i believe you can claim it back ) but it will cost her thousands in bailiff fees
I wouldn't advise anyone what firm to use but for maximum impact i would use Sherforce or Marstons have a googeI am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites

I personally would have stuck to my guns and insisted to be desolved of all responsibility due to their mis-management. However I realise it is easy for me to say that as it is not my credit file on the line and I appreciate how you have come to your decision. But seeing this message makes me rage a bit, FLM have clearly playyed you and its a case of them having their cake and eating it so to speak. They were happy to entice you by dropping the charges to get you to pay the main loan, now they are happy to clear you off the loan and pursue your friend.
This takes the !!!! somewhat.
I advise that you ask them for a full refund as you feel they have taken money from you by deception. Explain that you were advised the loan would be settled by paying the amount and that you still feel they have broken their contract with you by changing your contact details without your conscent and not keeping you informed on your account status.
I would see your bank about getting the transfer reversed as FLM are very unlikely to refund once they have the money. They have basically admitted that their contract with you is void by offering to remove you before the end of the terms of the contract.
Next step if you have the means to do so will be to take FLM to court, they in my opinion have committed fraud but I would take some legal advice on that area as I am no legal expert.0 -

whilst im still furious i am thankful their not being total gits and making me pay the whole lot!! i know i could fight it but what would that cost, how much time, hassle, i just want this behind me now and its a ££££ lesson learnt0 -
I still think their security questions need looking at..... they are regulated by the OFT so it may be worth a letter to them - that's if you still want to keep pursuing this.
It worries me greatly that someone has been able to phone up a company, pretend to be you and get details changed ..... and that they don't even seem to be bothered about it!Grocery Challenge £211/£455 (01/01-31/03)
