  • What a horrible thing for your ex-friend to do. Do you have legal cover on your home insurance or via your employer - because if so you can call them and speak to solicitors about anything thereby getting free expert advice.
  • Hi, certainly legally you can reclaim the money from her as it is her debt. However if she can't pay the original loan is she going to be able to pay your claim? Just something to consider before going to the trouble and expense of going to court. If she has a reasonable job you may be able to get an attachment of earnings from the courts and recover your money that way, but if she really has no money then she won't be able to give you any court order or not.

    And yes, it is always better to pay off any debt as quickly as possible.

    The reason loan/ finance companies ask for a guarantor is they are pretty sure that the applicant will default, they are much better at this than friends and family as they can look beyond friendships and trust .
    basically if the loan companies ask for a guarantor then it is usually a good sign that this friend is not all they are cracked up to be and are not telling you the truth about themselves.
    Which unfortunately as you have just discovered, they are usually right.

  • its all seemed pretty convincing at the time, she was selling her house- had moved into rented, said the company wanted a guarentor as she was renting.... if i had known the house was actually geting repossessed then obv i would never had done it, so annoyed!

    As she is a nurse i would consider threatening her with reporting her to her professional body (the rcn) as not a fit and proper person...may be worth a try.

    Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
    If you are planning to upsize the new house will cost more.
    If you are planning to downsize your new house will cost more than it should
    If you are trying to buy your first house its almost impossible.

    Issuing a summons and gaining a CCJ could be worth the money for a £2,700 debt. Even if she doesn't pay it will stuff her renting and gaining future credit (even though her credit is stuffed she may not have any CCJ's).

  • I think geoffky's route is worth trying you know. Just heard tonight about a friend's neighbour who is a paramedic and has been suspended because a supermarket are taking them to court for trying to use £28 worth of someone else's store vouchers... Clearly the NHS take things like this very seriously! If the friend thinks they could well lose their job, they might be more willing to resume paying the loan and start paying back the OP...

  • hi all, well to keep you all informed i have drafted the 2nd warning notice today ready for posting tomoz..... iv had some legal advice and i have to give them 14 days notice to find out what their intentions are (even tho i think we all know) then i can file an application to the courts (£95) ,, then get a track number (£40), then hopefully a hearing date (£160), then its up to the judge if he/she will issue a ccj - if so then i can either have an attachment of earningd order, bailiffs or loss of benefits................... personally i think id go for the bailiffs as i know they wont pay the others............... the sol was quite hopeful that i would win as iv done everythink right so far, documented everything and played by the rules, he also said that its probable that they wont even attend as they just dont care........ even if i dont get my money back fast or even ever then least it will prevent them from getting future credit/rentals/mortgages, might seem spiteful but they deserve all they get

    thankyou all for your advice, im loving these forums they give mega advice and i can see me turning into a right thrifty shopper/saver :-)
  • It would be good if you could get an attachment to earnings order because the employer pays that directly to you, whether the person wants them to or not.

    So you will get your money, unless the person resigns.

    well geoffky and skintand scared i have taken your advice and reported her to her boss- not for the loan as i dont think theyll be interested in a personal issue like that but she has used her work position to find out personal information on a woman her husband was allegedly having an affair with, she logged on and sought information out on the womans menatal health issues and child protection register ... clearly this is computor misuse and goes all again the nurses code of conduct, i ight not get my money back but she will pay in other ways.... karma always prevails :-)
