Claiming in England from Scotland

Firstly, what a superb site. Well done to all involved :T

My query is concerning claiming back charges from Woolwich/Barclays. I filled in the template forms from the BBC site after watching the episode of the Money Programme. I sent in the standard letter and statements from the last 5 years highlighting the various charges that have been levied against me over the last 5 years.

The letter was passed from my local branch (Kilmarnock) onto the Customer service team and then onto the Head Office Customer Relations in London.

I have now found out that the most I can claim for in a Scottish Court is £750 for a small claim and £1500 for a Summary, well below what I had asked for to be returned to me.

I believe I can pursue my claim through an English court as Woolwich/Barclays have their HQ in England.

What I'd like to know is if it is the same process as in Scotland and would I just file a claim at the CC nearest to the Barclays/Woolwich HQ in London?

Also, as I can claim for 6 years charges under English law, do I have to send them a new letter outlining this and the new amount which I am claiming back?

  • Not sure if this will be any use to you, but we had a similar thing but reversed (we live in England but claiming in Scotland - sort of) last year.

    My husband was claiming charges from his Halifax Credit Card. All letters were written to and replies came from Card Services office in Dunfermline. They didn't want to play ball, so we issued court proceedings. However, as we live in England we couldn't issue a claim against a company with an address in Scotland.

    Fortunately though, as they are part of HBOS group and their registered office is in Halifax, we were able to change the address for service so the claim could proceed.

    It's probably worth checking with your local court - I found the staff really helpful and they answered my questions no problem.

    Do you mean you changed the address once the claim had gone to court?

    We haven't got that far yet (and hope not to) but as we are due a lot more than the Scottish legal system allows, we feel it's the only course open to us.

    Hopefully it should work in the reverse then :)

    I'm in 2 minds whether to go with a company that reclaims the charges for you..
  • Just received a letter from Barclays HQ, saying that they will 'endeavour to meet the timescales outlined in your letter, but we cannot guarantee we will do so'

    They hope to have a solution within 4 weeks, a full report or an update will be made within 8 weeks.

    Is it best to let it run it's course and see what they offer before launching Court action?
