PPI Claims after bankruptcy

    Say the average is that 40% of PPI was missold, so the IS could try and argue that amount with the banks as a mass reclaim.

    Hi, sorry if I'm repeating anything here. But what if the cause of bankruptcy was because of PPI not paying out when it supposedly should have? Where do we stand with this?

    I had a letter about 2 weeks ago from some company, sorry can't remember the name, addressed to me which started off: Dear Discharged bankrupt, which made me mad to start off with as the Postie would have seen it :mad:

    It then went on to tell me that they were a company who could help me claim back my PPI's I had been mis-sold! and that they would be able to give ME the money?!! It also said they were writing again as I had not responded to previous letters (which I had not received)

    So I called them and asked them to remove me from their list, snotty chap on end said he couldn't do that as my name is on the London Gazette for all to see!!!! I said I know but I want it off of YOUR list, ok he said but you will still stay on all the public records :mad:

    I also pointed out they were wrong and that any PPI claimed would go direct to the OR, he said I was wrong and that any PPI they claimed would go to me as the OR has no claim on it!!

    But as I never had PPI on either of my loans then it doesn't apply to me anyway, I wish I had kept the letter so I could name and shame them, if I get any more I will come straight here and post, just wondered if anyone else has had any letters like this?

    I was just flabbergasted at the cheek of the bloke re my name being on public show and the fact they are claiming they can do something they cannot, it concerns me that others will go along with them thinking they can do this for them.

    Actually just thought I may be able to trace it through their phone no, will go and check my phone bill. Brb.

    They have been telling people porkies about being able to claim the PPI, and porkies about already having sent letters.

    They need to be reported, as their claims are deceptive, and as such breach several consumer protection laws.

    I sooo wish I had kept the letter but have been so busy with other stuff that I just ripped it up and burnt it in a temper after the conversation I had with the guy.

    If I get anything else I will be sure to act on it.

    I might be wrong here, but there seems to be one small issue neglected in this thread. If either a PPI premium reclaim or more likely a refused PPI claim which is then found valid is enough to wipe out the bankruptcy, then the surplus should not go to the OR ....

  • I went bankrupt 2005 and was discharged years ago. My estranged husband has asked me to fill a form in for miss sold ppi, for loans in joint names, prior to my BR. Would my ex be entitled to anything even if I wasn't?

    yes, he might if it was a joint policy, but you would need to inform the OR that a claim is being made as they would be party to it for your side
