I suspect the arguement would be had you had the extra cash at the point the PPI was being paid you wopuld have most likely use diot to clear the debt down/buy assets all of which would have directly effected the bankcruptcy.
Seems a bit unfair on an individual basis, ie some banks getting away with miss sales, but I suspect overall it will even out that banks have written off as many debts through bankcruptcy as they would have paid out on miss sales.
I doubt many would have been able to claim as much in PPI reclaims as they owed (so no PPI could have meant no bankcruptcy).

Hi, was hoping someone could shed some light on this for me.
I've recently been discharged from my bankruptcy and received a letter from my OR saying he has applied to be released from being trustee of my finances/estate.
So if/when he is released, does this mean I can claim my PPI charges back and keep any money I might be awarded? Or does it still go to my OR towards my debts that had been wiped with the bankruptcy?
Very confusing, hope someone can help!

When you went BR your right to claim any PPI transferred to the OR/trustee. It's now theirs to claim back.

Nope. The right of action and right to receive the monies still legally vests in the trustee/bankruptcy estate.

hi all
if i claim for ppi and the monies go to the OR does this pay off the debt we originally owe and if we get enough money that pays the full amount off what happens then? also we are in our 3rd year now and coming to the end of paying the OR after we have finished our 3yrs can you claim after this or does it still goto the OR?0 -

Hi there
I went bankrupt in 2005 and before this happened my bank forced me to take a loan of with my parents as security. This happened before I went bankrupt. My parents then had to remortgage there house and pay the loan off. The loan was not included within my bankruptcy and with not dealt with by the official receiver.
I called the bank up today and they informed me there was ppi on the loan.
Can I claim this money back as it was not included within the order it's self. ? I had to pay my parents off still. ?
Any advise would be great.0 -

Hi,
I was declared br in march 09 and discharged in oct 09.
I put in a ppi claim 8 weeks ago to the Halifax and they just sent me a letter saying they owe me £4500 but they will be contacting the OR.
Is it likely the OR will keep it or will i get it back due to the fact i have been discharged for 3 years?
The account i claimed back from was a cc that was upgraded twice and eventually included in the br. Because the claim is in reference to the 2 previous cc numbers but actually linked to the cc number that was included would this make a difference?
Any successful ppi discharged claims??
