Returning faulty phone still in warranty - Phones 4 U

I have a Blackberry Bold 8900 which I got through Phones 4 U last October. Recently, it stopped making calls and would cut out when others phoned me so I rang up Orange from a landline and they did everything they could to resolve the issue but couldn't do so. They also put me through to their dedicated Blackberry team who could do nothing. I then tried my SIM in another phone and it worked perfectly, leading me to the obvious solution that the problem is with the phone.
When I spoke to Phones 4 U regarding this, they said they could send it off for a free repair but couldn't supply me with a replacement temporary phone. Would I be right in saying that by law they should be supply me with a temporary phone given that they'd be sending mine away for 28 days? This not only constitutes an inconvenience to me but I'd be paying for a Blackberry internet contract while without a Blackberry.

You can try quoting this to p4u, but if they refuse you'll need to get a judge involved for clarifying what is 'reasonable' and 'significant' in this particular case.
BTW, before sending the phone take good photos of it and check the liquid damage indicators. Otherwise you are taking the risk of being accused later of damaging the phone even if you had not damaged it actually.0 -
Thanks for the speedy response! I was worried something like this would be the case. Nonetheless, will bite the bullet after taking pictures of the phone as proof of state it's in.

If I state that I can't find a suitable replacement and that I'm suffering a loss of income through this phone being faulty through no fault of my own, would this have legs to stand on its own?0

Iv never known any company offer a phone while you have one repaired unless you take out extra cover for that sort of thing. Im pretty sure its UPTO 28 days, its the same with HTC though its usually back within a week.The business argument would depend on you having a business contract I would think.0

I would doubt it to be honest...would be viewed the same as if your landline handset equipment went on the blink - you've got to think what you would do in that circumstance...and the most probable solution would be just to bite the bullet and replace completely, or buy a cheap 'emergency spare', to use while your 'main' phone was away for repair.
You can pick up a cheap mobile for less than a tenner...admittedly it won't give you BB functionality..but you'd still be able to make/receive calls.0 -

If you have a business acc you might get somewhere, if you're using a domestic acc for business then not a chance.0 -
If my TV stopped working I wouldn't call Sky and ask them to refund my subscription whileI got it repaired, likewise if my car broke down I wouldn't expect a refund on my car tax, it's just one of those things, stick your sim in a cheapo phone while you get yours repaired. As for using your phone for business, if you've got a domestic account you have no comeback in that respect0

Loss of income? That's consequential loss - and YOU would have to insure yourself for this, if you didn't it remains your problem. The same holds true for a replacement, they have no obligation to do this, only some firms think it good customer service, but it is not a 'right'. Again, you can insure and get a replacmeent if your main phone is out of commission, but this is something you have to do.0
