Why don't you want a reconditioned unit?
Surely, if they repaired yours it then becomes "reconditioned", doesn't it?
Some of Apple's reconditioned units are in fact brand new.

I know that your contract is with Tesco, but there have been a few posts on here stating that Apple have been very good when faulty goods are taken directly to one of their shops and it may well get resolved far quicker than letting Tesco sort it out.
I don't want a reconditioned unit because I've had about 12 reconditioned iPhone 4's from Apple and each one has been a bigger disaster than the previous. Even one of the managers in my local Apple store admitted that I wasn't having any luck. If they would actually repair my iPad and I would get my iPad back then that would be cool but Tesco Tech Support have admitted that it will get swapped for a reconditioned unit. Apple like to tell you that some of their replacement units are new but 95% of them are reconditioned. Seeing as the replacement units are in plain boxes there is no way to actually tell what you are getting.
The Tesco call centre said I needed to speak to Tech Support to get an authorisation code to be able to take it back to the store. Tech Support say they can't do this and I should speak to my store and ask if they an do refund it as a gesture of good will. My store says I need to speak to Tech Support to get a returns code. I'm going round in circles! If Tesco do refund my money I will be buying another one anyway, and probably the top of the range unit. I'm not just after a refund for the sake of a refund.0 -

the problem is, its not your choice what you get -it's Apple's.
The problem with Apple is they never replace with new - the irony with them is that they have so many go wrong they have a constant supply of reconditioned units - surely someone at somepoint has to say hold on a minute, this is is just wrong.
I feel for you, the example you give of 12 iphones underlines the point. The problem is, at that point you should have walked with your feet - they keep giving while people keep buying.
Alas its the beast that was born in cupertino...
For me I would go into an Apple store, faff yes, but same day resolution yes.
I'm astonished if you got a refund you would buy another...you are, and I mean no offense by this, but 'blinded' by the marketing0 -

I read that but I don't understand it (see my signature) so I was hoping for some one liners to quote to Tesco if you know what I mean? Or rather, just the actual bits that I need to know.0 -

Believe me, after the 6th iPhone I tried and tried for a refund but not knowing my rights properly I didn't get anywhere.0 -

If you DO get a refund, and I sincerely hope that you do, then make sure you don't spend it on another iPad.
I don't know the build or reliabilty qualities of iPads, but you seem to have a never-ending problem with them and the track-record suggests that the next one you get will go the same way.
Best to use the money to buy a similar product from a different manufacturer or even blow it on a short holiday somewhere to recover from all the traumas.0 -

The issue here is the ONLY way to guarantee you get a new, retail boxed iPad is to get a refund and rebuy - but there are no rights for that - the light bleed issue is cosmetic, it doesnt specifically affect the function of the device. Apple (who from this point on in this thread I will call lemon, why, well becuase I can...) will replace it because it costs them very little to do so.
You have no rights to get anything other than what you're being offered - you're best off swallowing your experience on the iPhone and going into Lemon and getting them to swap it out for you where you can try it in store and keep going till you get one that you're happy with.
Go see a Lemon genius and see what he will do for you0 -
Tesco are not budging. On the phone to CAB to see what they say.
If they can't help then I may pop in to the Lemon store. If they will repair my iPad, which is what I will insist on then so be it. If not then I'd rather live with it, at least I know my iPad is perfect in any other way. Plus, my iPad is running on iOS5 which hasn't officially been released yet so I might get too many questions from apple, and it's a hassle to get hold of my friend who's an app developer to get him to register any replacement iPad I may get.0 -
you have to bear something in mind, Lemon don't make hardware, they don't repair hardware - you cannot insist lemon repair your device, the choice is theirs.
The fact you are running an unreleased iOS could actually have your deviced siezed if Lemon should chose to do so - or they could also refuse to touch it till you have a valid Lemon install.
Either way, if you would rather live with the Lemon device than have Lemon give you another Lemon (like what I did there) then I would say give up on the CAB and just live with it - you can't unfortunately have it your own way with Lemon, despite what the marketeers at Lemon would have you believe about their products.
