Good morning all! I recently recieved a letter from HFO Services regarding a debt with Welcome Finance. I took out a loan in January 2005, became unemployed and could not afford to pay. Never heard a thing until 2008 from HFO. Was wondering if this is now a statute barred debt? I have never made a payment since 2005, nor have i put in writing the debt is mine. The only contact i had was i sent a letter to ask for a copy of the CCA. Could this be statute barred as i have never admited liability?

If HFO are involved, it'll more than likely be statute barred.
But what month in 2005 did you last pay/make any written acknowledgement?
Personally, I would send the 'I have no knowledge of this debt' letter first - and then, once they respond, send the 'statute barred' letter.
That'll make doubly sure that it passes the SB deadline, by which time, HFO are helpless.
Also, remember NOT to speak to them on the phone, and don't provide any signature to HFO at any point for any reason.0 -
what was the date of the first missed payment and also the date of the last payment you made?
hfo will lie to you without hesitation as to whetehr the debt is statute barred, so the dates are important0 -
I cannot remember the exact payment dates but am certain it was early 2005. maybe some postal ping pong to be safe to exceed the SB date?0

if its statute barred then they might threaten court. they wont actually do it or would lose if they try0 -

You have contacted us regarding the account with the above reference number, which you claim is owed by ourselves.
We would point out that we have no knowledge of any such debt being owed to The Loan Company.
We are familiar with the ‘Office of Fair Trading Debt Collection Guidance’ which states that it is unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.
We would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.
Furthermore, ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.
We would ask that no further contact be made concerning the above accounts unless you can provide evidence as to our liability for the debt in question.
We await your written confirmation that this matter is now closed. Otherwise we will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.
We look forward to your reply.

Hi again! Recieved a letter from HFO saying as i have not been in contact (i sent the statute barred letter 20 september with POD) it has qualified for legal action along with lots of HMCS documentation, and if i dont make contact within 3 days they will commence litigation! When i arrive back home i will upload a copy of the letter. Any advice anyone can offer will be very appreciated.
