Chances of an appeal?

Today I received a parking ticket from Central Ticketing. They called it an 'Excess Charge'. The ticket was issued 4 minutes after I had parked and I was back at my car 9 minutes after the ticket was issued. There is a lot of work going on in my street and there are not as many 'normal' spaces as usual. I was only parked a short period of time to drop off some frozen food to my house.

On the ticket it says the excess charge is £100, reduced to £65 if payed within 14 days. Their website outlines that they only have 4 types of parking charges, none of which are as high as the one I have been issued.

The ticket also gives two different addresses for any appeal to be sent too. One in Edinburgh and one in Birmingham.

What are my chances with an appeal? Any help or advice would be welcomed.

    Can you clarify, were you parked on the street (as in a public highway) or on a private car park?

    As to the ignore advice, I have read through other threads and figured that they cannot enforce any 'fines' without a ccj. I had a ccj against me about 7 years ago and do not want to risk another one.

    They will not take you to court... if they did, what would their claim be? They are only entitled to persue a caim for 'loss or damages' so I think a court would consider a charge of £65 would be disproportinate and therefore a 'penalty'. A private company cannot (under current law) issue penalties.

    There is more chance of CCJ if you can be identified as the driver in any way, such as by appealing or posting on a forum...

    From a LEGAL standing : You have been given an invitation to pay a private invoice.
    It is Legal to invoice anyone for anything you see fit, you can legally sue them for not paying it.
    Now the trouble starts when they try to win the case, the law clearly states that private companies can not charge penalties, they can only claim what they have lost, they can not make subsequent charges for administration chasing that loss.
    So they could only effectively sue you for the bit of parking you did not pay for which is 9 minutes of whatever rate they were charging.
    I could send you a excess charge notice for not polishing the wheels on your bin and sue you for not paying it, but what do you think my chances of winning in court would be ? The same as a private parking company... NONE
    Instead they BUY your private details from DVLA (if you ignore the appeal- if you do appeal you save them the fee) then will send endless bluffing, huffing and puffing and threatening to blow your house down, fake debt collecting letters, fake solicitors letters, fake court threats for a fake parking ticket.
    The whole show is FAKE !
    Ignore and get ready for the silly letters.

    BE WARNED : The appeal is judged by the scammer who issues the tickets and those who do pay have reported back on here multiple times of been threatened for even more money for late payment charges, that is because it is a scam and most scammers come back for more money when they find a mug.

    Oh for gawds sake please read the forum more carefully, that's not what we say. We say their fines are unenforceable full stop and they will not go to Court as they know this. You cannot just collect another CCJ like collecting stamps. There will be no CCJ for this fake ticket, there is no risk, this is a scam.

    You must sit down and read a few more important threads. You need to see the Watchdog paper aeroplane excerpt which is linked in a sticky (permanent info) thread near the top of the forum thread list:

    It's an absolute must-see for people who actually think a Private parking fake ticket is a real one. The Watchdog link is on the sticky thread near the top of that list called 'WELCOME, please read before posting'!!!! :D

    Then look at the top sticky thread 'PPC letters, what to expect' and make sure that the registered keeper of the car is ready to play a fun game of snap with each matching letter as it arrives. The Central Ticketing letter-chain is on there, take a look now to see what might come next.

    Yes the scary letters do look sort of 'official' and will be on debt collector and maybe 'let's pretend we are a solicitor' headed notepaper. This is part of the scam, so nowt to worry about and there is NO DEBT anyway so you can see you are on safe ground (when did you ever sign a credit agreement for these con-merchants?!).

    You will not go to Court; that's so rare it's almost unheard of; the odd other PPC that does chance its arm once in a blue moon lose almost every time with a defended case. No-one will come knocking, no bailiff will call.

    Nothing about ignoring this con will affect your credit rating or get anywhere near risking a CCJ (in spite of what their scamograms say). Just keep ignoring and post back here again if you get any letter that's different from those shown in the top sticky.

    Next time just laugh if ever your car collects a piece of unwanted rubbish called a parking charge notice (a real PCN is a penalty charge notice).
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Thanks for the replies folks. Apologies for writing about enforcing without a ccj, it was worded incorrectly. I was too hasty in rushing through various threads not reading correctly.

    There is no appeals process. It's just a speculative invoice from a well known bunch.

    Simply ignore. Central Ticketing have never ever taken anyone to court in their lives anyway.
