successfull dla appeal

i won my dla appeal on 25th august 2011 i had asked for lower rate of both components but the judge said they wanted to consider higher rate mobility as soon as i walked(well crutched) in the room, i didnt take a representative i did it all myself and was awarded higher rate mobility and lower rate care.
my question is i have been awarded it from 11th july 2010 so what happens with what they owe me from then? and how long does it take to start recieving payment any help would be appreciated!!

    It should be backdated from july, usually takes two to four weeks to sort out.

  • i have just rang them and the girl on the phone said that they recieved the papers on tuesday and it is with the decsion maker to input on the system does that mean im getting my payment once hes input it?

    amanda I don't think anyone will know that level of detail here sadly... unless they're involved in your case at the DWP. 2 to 4 weeks sounds like a realistic length of time to resolve from date of the tribunal... to start paying you your DLA and the backdated DLA.

    Well done... and if you see nothing in your account (and the backdated amount should stand out..lol.. it'll be significant.. about £4000 if my quick maths is right and you've had no monies from them since July 2010) in the days leading up to surgery I'd be inclined to contact them as it would be reasonable to have expected them to have acted by then (4/5 weeks) and it'd be nice to have matters tied up before hospital.

  • Once the tribunal decision is received back by the DWP, they do have to opportunity to appeal, although this is not often the case and they will ensure that the decision is correct in law.

    You will probably get a form through the post before payment is made, asking about time out of the country, and time spent in hospital.
    This is due to these events affecting the amount of back pay that is due.

    Once you send this form back, then payment can be processed.

    thanks for the info guys, no i havent recieved a penny from them ive just had esa and WOW i didnt think it would be that much!!. munchie would that mean another appeal......sounds awful been fighting over a year already hope i havent got more to come!!! i have not been out of the country or been in hospital yet i go in on the 30th september but fingers crossed its only for 2 days

    Yeah..lol.. HRM plus LRC would be about 50 plus 20...£70 per week... owed for maybe 13 or 14 months.. let's say about 58 weeks... 58x£70.. about £4k.

    Regarding the other issue... it is a slim possibility they could challenge the decision. You have the same option. But the challenge would be on the basis of a claimed 'error in law' made by the tribunal. A successful challenge would probably mean your appeal is struck out and re-ordered. However... all of this is unlikely. It's one of those possibilities in the background you just have to assume won't arise or if it did that it won't come to anything.

    Well i hope it doesnt get challenged and the girl i spoke to yesterday said to just keep checking my account as ill get payment probably before my award letter dont know how true that is but ive seen a few on here that have been waiting 4 weeks and heard nothing guess ill just have to wait and see and hope its sorted before i go into hospital. :) Ill just look forward to my surgery instead lol :)

    Just to add, my wife and i had our sons DLA appeal 2 weeks ago, he was awarded higher level care for his autism.

    We first applied in May 2010, it was backdated till then a sum of around £4,700.

    They contacted us early this week and we was told should get it next week.
