I see your argument JamesD but I think it would fail.
The bank has the right to change its terms and conditions and can defend a complaint by arguing that it is the legitimate exercise of its commercial judgement and outside FOS jurisdiction.
The OP could say he did not receive notification of the change but FOS would conclude, on the balance of probability that he did - particularly if the bank can show a payment was made in response to the statement it was sent with.0
