I really wanted to go see Eminem at the v festival and purchased a ticket on seatwave just after they sold out for £190. As the time grew nearer I couldn't afford to make the trip to London. So I just relisted it on their site. It sold for 120 and I would only be getting 105 back after fees. The festival was on the 21st of august and i sold the ticket about a week before and still hadn't received the ticket i purchased. I received it on the 17th and sent it on the 18th as I didnt get i until after work the 17th which the post office was shut. I sent it first thing on the 18th an the buyer signed for it the 19th. i had no access to normal internet to type in the sent SD tracker. After the show i tryed to log on to see what was happening with the payment and i could not log on. I sent seatwave an email which took them days to reply. They stated they would not be paying me. They said they tried to contact me, which I had no missed calls and my dad was at home the day they stated they called as he was waiting to sign for the ticket which never came. They did not send me any emails as i would have received on my mobile. They said the sent a replacement ticket and that seller received the payment. This means someone received two tickets which one was mine. I have mailed seatwave 4 times trying to get an answer which I kept getting the same email that i would not be being paid. I've called them twice today and this morning the lady said they would pass it to the solution team and they would call back. As I did not receive an email or phone call I decided to call back. The second lady said my email details where nowhere on the system etc. and that they would not be paying me. I really don't know what to do as I have lost out on a lot of money and the buyer technically has stole my ticket now. Can anyone help??:(

Yeah 500 pound, but it got delivered I just haven't received the money from seatwave, can royal mail compensate me?0

You say the buyer claims the ticket never arrived, so RM may be your best option.
However, you say the buyer signed for it... is it the buyers signature? Is there anyway of verifying this? If so are seatwave simply agents between you and the buyer and if so I assume the £115 was placed in escrow during the transaction? If you can prove delivery it may be a case of persuing the buyer via small claims court.0 -
Seatwave said they tried to contact me on the 17th which I am unaware of, so they sent the buyer another sellers ticket the same day I sent mine and he got two tickets. The other seller got paid and seatwave said I wont be.0

Does it say anything in their terms and conditions about having to provide tracking details by a certain date/day/time? Or is there any other procedure you was supposed to following which you didn't?
If the buyer is not claiming to have not received the ticket then you don't have a claim with RM.0 -
It did no make me aware as it had said to claim postage send them the code within ten days, It also says they will send replacement tickets within 2 days before the show, they did not email to say they tried to call or that I needed to confirm that I was sending the tickets and because I only received the ticket the day they now state was my deadline to post the ticket. I know they have a point about me not confirming though I did not have access to the internet, the buyer still received my ticket and most likely used it as well as the other ticket. How would I go about contacting the buyer as now thats classed as stolen technically?0

It's not classed as theft as you willingly sent them the tickets.
Was you given a date you was required to dispatch by and did you inform them of the dispatch?
It looks like you breached contract by not providing them with tracking details.4.9. Dispatching Tickets
You agree to send the ticket as soon as possible after confirmation of the order or the receipt of the ticket using the delivery method we specify (an A4 envelope and usually UPS or courier). If you do not ship the ticket using a mailing label provided by Seatwave, you agree to communicate the shipping tracking number to us in a form we may stipulate from time to time. You will not be paid if you fail to provide a shipping tracking number. If UPS is able to ship the ticket from you to the Buyers' address and you do not use UPS to ship the ticket, you assume all liability for the successful delivery of the ticket. Tickets must be posted out to the Buyers (or to Seatwave as indicated at the time of sale). Sellers are not permitted to hand-over or hand deliver tickets to Buyers. If a Buyer has not received from the Seller the tickets in good time before the start of the event or at such earlier time as the Seller is notified by Seatwave via email or telephone Seatwave will cancel the sale and find alternative tickets for the Buyer.Please see clause 9 (Financial Consequences) for charges imposed for failure to deliver a ticket.0 -
I did not willing send them as they did not let me know my sale was cancelled, the buyer purchased them on the 15th and if it fell under last minute sales I could actually have hand delivered them. So basically can I not do anything? I just want my money back or even the buyer who used my ticket to get billed.0

You willingly sent the ticket, as in you wasn't under duress or forced to post them. To steal would be to take something against your will.
The buyer was sent tickets from a different seller which they used, yours will remain unused.
As you didn't supply them with tracking details as stated in their terms and conditions, they have cancelled your sale and supplied the buyer with alternatives.
I'm not sure though if you could argue to point they never contacted you, but it's worth a shot. I wouldn't get my hopes up though unfortunately. It is infact in their terms that shipping details is mandatory.

They said they contacted me on the 17th, I only received the ticket i purchased that day and sent it straight away in the morning as i work all day and didnt get it until i got home. I doubt mine would not have been used as seatwave where unaware that they received my ticket and also they did not return it to me. My ticket got to the buyer in time before they are suppose to send replacements it was on the buyer who is also meant to type in the details of the received ticket. Im just actually very gutted as I purchased to tickets for 300 pound and I sold one I couldnt sell on seatwave on ebay for 50 pound and that transaction was smooth, now im £250 out of pocket and possibly someone has got a free ticket. im not sure when it was cancelled as they did not email me or call me or nothing to tell me and suspended my account without even letting me know.0
