Three Mobile Cooling off
Options
Hi all,
I got a 3 Sim only contract 7 days ago.
Managed to make a call or two from work since then BUT have no reception at all when at home and None when at work. I only managed to make those calls while outside in the rain.
I had transferred my number to Three on the first day of this contract and called up to cancel and get another PAC code as I need to keep this number for business.
As I have managed to make a couple of calls with the Sim does that mean the 14 day cooling off period no longer applies? Do I have to pay a full month? If thats the case it would have cost me £12.50 per minute for the two calls I made.
Any advice appreciated.

New and unused.
If you want to return or exchange your device, it must be in “as new” and "unused" condition, without any damage or marks. It must be returned with all packaging, manuals, accessories and any free gifts that came with it.
...
When we say:
- “Used” we mean making or receiving calls (both voice and video) or texts or browsing the internet from your device. If you’ve bought an Apple device from us, this includes removing the cellophane wrapping or registering your device to iTunes by connecting it to a computer.
- “As new” condition we mean that the device, packaging, manuals, accessories and any free gifts that came with the device must be complete and free of any damage or marks.Do I have to pay a full month? If thats the case it would have cost me £12.50 per minute for the two calls I made.
If you are not sure about reception it is always worth asking other people or checking it with a free PAYG sim first.0 -
Hi, thatnks for the reply - I am within the DSR Period - It is 7 working days I have just found out. I have only had the contract for 5 working days. Does this change anything?0
-
DSR apply only to unused goods and services.
What did '3' say when you called to cancel and request the PAC?0 -
I would call them and see what they say.
I have had an orange contract where I was not happy with the phone, used it, then returned it under their 7 day period.
They refunded all and only charged for the actual calls made.0 -
Three said I had to pay the full 30 days contract etc. Thats why I wanted to see if they had the right to do that.0
-
Pretty harsh but I suppose they are within their right. Wont ever use them again. If anyone has any ideas that would be great but looks like im on a losing battle0

Even if it was a cancellation under the cooling off policy, it would be difficult to say what amount would be fair.
As you used a very small part of the monthly allowance (what is the case) you prefer to pay the PAYG rates.
If you used almost all allowance you'd be very unhappy if they suggested you to pay PAYG rates instead of the contract monthly price.0
