Think Item I Won Is A Fake

I won a DVD last week and it stated it was region 1 and new. The disk arrived this morning and it just looks fake to me. The wrapping that surrounded the disk was just a sealable bag, the disk is golden colour, although the cover looks fine. When I put the disk into my multi region player it just comes up with disk error.
I have emailed the seller and told him this and that I would like a full refund. I doubt if I will hear from him again, let alone get a refund and I am going to hold off leaving feedback until I have some kind of response.
My question is: if he does give me a full refund, what sort of feedback should I leave? Would you leave a neutral as I have had my problem dealt with but still state that I believe it to be a fake or would you leave negative?

I think I would leave neutral saying something like,
Disc wouldnt play no matter what I did.
Does it play in your PC DVD player(if you have one) .Could be he copies them,tries them in his pc(where they would probably work) and sells them.
I wouldnt say they are fakes though as they 'might' not be and that would be libelous.0 -

If you bought the disc in good faith then you won't have commited any offence. I would have thought Trading Standards would be glad of the tip off if it is fake.0

Just had an email back from the seller. He has sent me a Paypal payment for the full amount (less what Paypal charge). Oh well, I thought I would have lost all the money.
I decided to leave him positive feedback but just said that the disk wouldn't play on my machine and a refund was given.

Firstly, when they refund you through paypal, you get the full amount back, as they refund the charges as well!!!
Secondly I would leave neutral as they have wasted your time.
Thirdly I would report the seller to Ebay so that he doesn't get away with it again. It is illegal.0 -

How can I be absolutely certain that it is a fake? It is a region 1 disk and the underneath is gold in colour. I have never seen "original" disks a colour other than silver, but I would have to be absolutely certain before reporting him.

You could always take it into a DVD store and as them if it is real or fake I suppose??0

I'm pretty sure it'll tell you whether the disc is a copy or an original, you'll be able to tell by the media code.
Edit: assuming you have a DVD drive in your computer, that is!0 -
It isn't illegal to buy countereit items in this Country. Trading Standards will be interested in the person who is selling the copied stuff. There is a possibility the DVD is genuine but has been imported from abroad. So the seller could be selling unclassifed material- which is also an offence under The Video Recordings Act. Does the DVD carry any of the age rating logos?
