Help Needed on Missold Phone
Options
Hi there,
This is the first time I've posted on one of these forums so please bear with me as I need some advice on a phone I was sold recently.
A couple of weeks ago I was sold a HTC Sensation phone by Carphone Warehouse (in store and upgraded my previous contract with Orange).
Whilst in the store I asked a few pertinent questions about the phone:
1.) Does the phone have toughened or Gorilla glass?
The store/sales rep told me that the phone didn't have this and that the only make doing this at present was Samsung. As a result they told me that to prevent the screen from being broken I should buy a product called "Invisible Shield" for £15.99 and it would also prevent any scratches.
On later investigation on the HTC website I found the phone does have Gorilla glass and that Samsung do not offer this on any of their phones.
2.) Does the phone support UMA calls on the Orange network?
The store/sales rep said that yes that model does support UMA calls and it also allows for SIP calls too. I asked the question as I live in an area where the signal isn't always great and wanted to take advantage of this feature on the Orange network. When I got home I tried the feature and couldn't find the feature anywhere. I contacted Orange who replied several days later and said they only support Blackberry models and a handful of others - mine wasn't one of them. When I looked at SIP calling it turns out that I can only make free calls to other SIP users if they are with the same provider - just like Skype.
I contacted Carphone Warehouse about 5 times before I eventually got any sense out of them and they admitted two counts of miss-selling; one for the phone screen/shield and the other for UMA calls.
I've been told that to resolve the issue I need to go into the branch and speak with the store manager in person. They have said that they will probably try to give me a Blackberry phone instead and on the same contract. I've already said that will not be acceptable as I have a Blackberry as a work phone and can't stand them.
I was wondering if somebody out there could give me some advice as I feel that I've been miss-sold a protective screen cover for a phone that already has toughened glass, told the phone would make UMA calls when the network provider doesn't support and now locked into a contract for 2 years with a phone where I can't always make/receive calls due to signal problems.
Any advice would be gratefully received,
David.

you've already been told by Carphone Warehouse that that miss-sold you the items and to go into the shop and speak to the manager. What other advice are you looking for?0

Standard on Samsung Galaxy last years model and the new one .
But from what you post thats not relevant anyway to the fact you received wrong information in regards to your questions.SOGA entitles you to a full refund .

I don't know what SIP is, but I don't see how you were missold because of this.
Yes, you were missold the screen protector(s), but this has nothing to do with misselling the phone.
I think the only real point is UMA. I am no expert, but I see Desire S among "handful of other" phones that Orange support. It's a different phone, but very close. I wouldn't be surprised if Orange expert give you a different answer if you ask them again. It's just an android app after all.0 -
Nokia have phones with gorilla glass and are older than a few months old. You should have checked before you took the phone if it had gorilla glass eg : Checking the box the phone came in before your purchase.0

Perhaps you could do some in depth research on a more suitable phone so you're suitabley armed with some good knowledge before you go back to the store. You may find that CPW will be accomadating - you haven't tried them yet? I think a refund on the screen protector is probably due to you.
As they've admitted miss-selling, you should have good grounds to swap the phone for something more suitable but I don't think you will be able to get out the whole contract?
Hindsight is a wonderful thing but perhaps you could/should do a bit more research yourself next time before you commit to buying something?
In any event, you need to go in and see CPW - you may be pleasantly surprised....0 -
i have a Galaxy S2 and mine has Gorilla glass.*The RK and FF fan club* #Family*Don’t Be Bitter- Glitter!* #LotsOfLove ‘Darling you’re my blood, you have my heartbeat’ Dad 20.02.200

I have a UMA handset on Orange. LG Optimus One. Orange web site listed which handsets were UMA enabled on their site.
But even then a word of caution. If you buy an unlocked handset from CPW, even if Orange say a handset sold by them is UMA enabled, unlocked versions that have not been tweaked by Orange are NOT UMA enabled. CPW tend to sell unlocked handsets!
The second point is proof. I believe you 100% but you are going to need to be able to get the shop to admit misselling and then be prepared to swap handsets or persuade the network to cancel the contract. If it comes to a he says - she says and you have no witnesses, you will probably lose if they deny your version.
It's a pity you didn't check out the info you provided in your original post before buying.

If you don't want a Blackberry then you need to find a phone that is suitable and ask them to replace it with that. If they have nothing you want then ask them to cancel the contact and you can go elsewhere.
There is no other advice to give.0 -
I believe that the only phones that can use UMA on Orange are those sold directly by Orange and not via a reseller.
(I think there was a thread mentioning this a while back)

Gorilla glass can still be scratched so you may want to keep the screen protector.0
