Can a travel company take money from me 2 years after my holiday?

  • Thanks all for your posts. The bank are sending me copy bank statements so ican double check. For info, I do check my bank statements so am pretty sure I have paid it already. Just didnt think I'd have to keep them to prove it 2 and a half years later!
  • i dont think i would be happy with the situation. ( as they hadnt taken it out on time)
    but if i had the holiday and had'nt paid for it i would EXPECT to be asked for it.
    pay up if you owe it, dont pay if you dont.

    Yes they can legally DEBIT your account because you have GIVEN them permission to do so.
    You can withdraw this permission by cancelling the debit account with the holiday company via your bank.
    Speak to the bank and cancel any direct debit set up with any company you do not recognise.
    If it was a debit card, set up a new one.
    wait until you have done this, then ask the company to invoice for what it thinks it is owed as you hold the invoice in dispute.
    The onus is on the company to prove they are owed the money, there is such a thing as conclusion of contract .
    I would have thought that any contract with this company was concluded.

    Is your bank charging you for the copy statements?

    If so (and you find you do owe the money) I would strongly suggest to the travel company that THEIR poor financial processes should not cause you to be further out of pocket.

    Suggest that they have their money LESS any bank charges you incur for checking such an outdated "claim".

    I look forward to hearing what happens as I have a holiday booked with the same Travel Agency for next January - it's making me nervous that their financial procedures could be dubious and could lead to cashflow issues for their business.

    If you found out a company had overcharged you by several hundred pounds in 2009 would you request a refund or just accept it?

    Sorry but I am sure I would have known at the time that I was being overcharged and if I did not then that would be my own fault as far as I am concerned !
