HELP West Coast Mobile Co. Not letting us cancel within the cooling off period

You usually get seven working days to cancel your order if you buy your phone or sign up to a new contract:
by mail order
by phone
online
But if you activate the SIM card, you usually lose this right to cancel.
If there is nothing wrong with a phone you bought in a shop, you have no legal right to return it. Some shops may let you return the phone if you provide the proof of purchase that the shop wants, eg a receipt and the box. Check the shop’s returns policy before you buy.
Hopefully things will sort themselves out, but don't get caught again.

O2 are being very helpful ..the rep actually taped some of the conversation and this has been sent to HTC on request.
West Coast rep told us the email would be sent to O2 with my daughter's email copied in.

Maybe you could try ringing them - might get through to some complaints department, save you the hassle of going to the shop to confront the sales person.
The law on contracts is you get cooling of period for new contracts but not in high street. Some retailers though do allow cancellations for high street purchase. For upgrades though there is no cooling off period in law but again its down to retailer policy.
Its all a load of #$£%^ - the law could be clearer.
In any case, if you have returned the phone - I just cannot see how you could be tied into an upgrade.0 -

My daughter and the O2 rep have spoken to the 'apparent owner' of West Coast mobiles and he said the contract will be closed as they were sending the email.. but as yet it hasn't been received.
The Contract she was given by West Coast mobiles states that there is a 14 day cooling off period where the contract can be cancelled.
I think this is why they are being so unhelpful and trying to drag it out until the 14 days expires and they will say she has no right to cancel.0 -

The O2 rep phoned HTC and complained and they are looking into it as this salesman is representing their company....

The HTC rep was very concerned as this salesperson has sold an HTC phone contract and was very rude, not only to me and my daughter and the O2 rep but to various other customers previously, who have been into O2 to complain.
The HTC rep was informed that their company was being represented and he will be investigating the sales technique being used to market their product.0 -

I see that you are having problems with returning within the cooling off period - because it is PITA for the retailer to cancel the contract. I don't see anything wrong in 'sales technique' except your adult daughter acting like a child.0 -
This is nonsense. The salesmen sold HTC phone and O2 contract.
I feel really sorry for HTC. Their company was not represented by anybody.

Yep..it's definately a 'PITA' for the retailer or the rep to cancel, after all they will lose their comission! of course they are going to be fed up and try their best NOT to cancel it.
