Can I claim charges on a defaulted account?

The charges were incurred before I defualted on the account - which is what actually lead to the default in the first place. Do I have a case for reclaiming these charges?

    1- what charges?
    2 - what makes you think you can reclaim the charges?
    3 - you haven't paid the charges so what makes you think you could reclaim them?

    If you mean PPI charges, yes, assuming they were sold to you illegally.
    Can we just take it as read I didn't mean to offend you?

    illegally is a strange word to use. No-one has actually been found to sell them illegally.

    If is PPI and not charges, then a complaint can be made stating reasons for mis-sale and if the complaint is successful, they will use the redress against the default

    i don't think DunstonH was being pedantic, he was correcting a commonly spouted phrase that PPI was illegally sold, much like when people ask if they can "claim their PPI" when in fact they mean complain that it was miss-sold and ask for a refund.

    Whilst not accusing you or anyone else of 'dumbing down' (expt ths tht use txt spk) we need to make sure that we are using the correct terminology otherwise people will get confused, get the wrong idea, and possible muck up any possible complaint that they have.

    How do you incur default charges on an account before the account is in default? :huh:

    As for "superior knowledge", well you came here looking for advice and so presumably wanted that from someone who knew more than you on ther matter. Or was there an alternative reason for your post? :huh:

    So is this about PPI? That's perhaps what is confusing many people.

    This board is for debating the reclaiming of bank and credit card charges. There is a different board for debating the recliaming of PPI and other insurance that can be found here.

    I started to claim back p.p.i. before going bankrupt in june 2010 on my credit card which had debt.They were dragging there heels and now they have told me I am owed £976.00 .I was discharged in 2011, can I have the money because the account is closed.

    They are allowed to use the money against any debt that was written off as part of the bankruptcy.

    Remember that you effectively haven't paid this PPI payment as your defaulted. So, therefore you should not be entitled to it. Your creditors should get it as they are the ones that lost out. You did not. You will only get it if they dont realise you had a debt with them or you happened to have no outstanding debt with them.
