New letter from excel,are they taking me to court?

had the 1st letter giving me 14days to pay £100,this also states "it may result in court proceedings"

the new 1 i've had is a "final demand prior to court action" and also states "failure to pay this will result in court proceedings"
this does imply to me that they are taking me to court
this is a copy of the email i sent to them for appeal

I parked on **** car park mansfeild and as you can see from my
address above im not local and so have never used this car park before.i
had a look to see how much i needed to pay and saw it was free for 30
min.i was in the shop 15-20max.when i came out i find a ticket,i went
and had another look to see if i should have paid to see that you needed
to show a ticket.
Now im not saying i should not have got a ticket but as you can see from the photo the free parking is in large bold writing and the display
ticket is very small.for the sake of printing a free ticket why would i
risk getting a ticket .unless it was an honest mistake
I hope you can help with this matter

The advice is just to ignore them from now on and cease all communication with them. Excel will not do court. They tried it in Mansfield a couple of years ago and lost spectacularly.What part of "A whop bop-a-lu a whop bam boo" don't you understand?0

So far as I can see, you parked for 20 mins but did not get a fre for 30 mins ticket so they have lost the grand sum of £0.00, this won't get anywhere near court.
Continue to ignore and come back if you are worried by their next threats.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0 -

I noticed the word 'LIES' and for some reason it stood out to my eyes.
Perhaps it is the font spacing.0 -
Observe the over-use of the word "MAY". No backbone, no conviction. They know they have no-chance, they just hope that the words, in bigger, redder font, "court", "bailiff" etc will frighten innocent victims.
What they fail to outline properly is that IF they take you to court, they HAVE to WIN (and precedent tells us this is about as likely as seeing pigs fly!) and you have to still refuse to pay for the PPC to BE ABLE to APPLY for bailiffs to recover the debt etc etc. It's not as if you are going to be in county court tomorrow and have bailiffs just turn up on Friday, as their letter could (for them, hopefully!) imply.
If they DID, on the 0.00000000001% likelihood of it ever happening, have the audacity/foolishness to take you to court then they would certainly lose and you could then ask the court to charge them with the costs you suffered dealing with these muppets (been done successfully before!).
Chillax. Let them keep wasting their money writing to you. Parking was free, so by parking, you caused no losses whatsoever to be sustained. In the EYES OF THE LAW OF CONTRACT you did nothing that is actionable. Please don't use the word "appeal". It implies that these companies have some kind of authority, which they do not, and implies that you are dealing with honest, fair, individuals. And PPC's are cetainly neither of those two things. And worst of all, appealing suggests that you accede to their purported authority, which makes you an easy target for them!0 -
Excel don't do Court any more as they can't put a case together - their modus operandi is to send letters to scare people into paying pointlessly.
It's a very very rare PPC that actually tries a Court case, one such PPC lost today (See post #38):

Best thing to do is look for Coupon-mad's posts that contain the info about PPC's with links to this site and the watchdog videos, cut and paste into LibreOffice Write, then print out as many as you can, pop them in resealable bags and pop them under the wiperblades of any car you see with a PPC-issued PCN on the screen.
The more people who are told, the less income for the PPC's.Never Knowingly Understood.
