    I bought a house where the owner didn't move out... We completed, got keys, turned up and he was casually moving a few bits here and there. This was Friday, took him until Sunday to get everything out... Fortunately we were gutting and renovating as we would have been totally stuffed if we'd been waiting with a removal van. Only advice from solicitor was to try and sort it amicably as it would get expensive to try and force him out of OUR house!

    I'm sure it will go OK tomorrow, and I hope you enjoy your new house!

    Sparkly saver - that did make me laugh! I wouldn't have had a clue what to do!
    Neil in Bristol - thanks for the suggestion, my solicitor told me he would transfer the funds on Friday morning so I just assumed that was how it worked, I'll check whether he can wait for confirmation. He is aware of my panic(!) as we were due to exchange contracts last week on Monday but because the vendor forgot (on two occasions) to drop his contract back to his solicitor, it was delayed twice until Friday. This is another reason why I'm worried he'll forget to drop the keys off!

    I guess we'll find out tomorrow who was talking bull****, and who was panicing over nothing.

    Running Horse - may I remind you that this is a forum where people come to ask advice and help about things they are unsure of and want answers to. So far you have contributed nothing of use at all. I realise that everyone is entitled to their own opinion but you don't need to be so hostile in your posts. As for your 'aggression' comment, I'd hardly say I was being aggressive, I am understandably nervous after weeks of stalling by the vendor and delay of exchange of contracts.

    I hope I am panicking over nothing, I will be a very happy bunny if completion goes through smoothly :j
  • despite one or two flippant remarks, things do go wrong so its natural to worry after the carry on you have had so far. My parents were left high and dry waiting with their removal van outside their new house only to find that the vendor's money had not come through for his own house in England( we are in Scotland). This was on a Friday. Luckily they were able to stay with my sister nearby but they spent the whole weekend wondering if they actually had a house at all now.
    Turned out the bank sent the money to the wrong account. Both sides were compensated but its really not worth it when you see you are worried about your dad who was recovering from a stroke.

    Anyway, episodes such as the above happen rarely. Have a bottle of champagne chilling, don't worry about unpacking everything all at once and sit back and enjoy your first night in your first home together:)

    We had something similar.

    Basically husband didn't want to sell and wife couldn't care less. It was a divorce situation. She had to find council accomodation all of which took time.

    Anyway we completed at 11 and went and collected keys but discovered at the new house the husband hadn't started moving stuff out. Wife and kids were off with new bloke somewhere.

    I spoke to solicitor who told me vendor has reasonable time to move out but if he hadn't cleared by end of day he would speak to other solicitor.

    The reality was we could put furniture in storage and charge vendor but the hassle and costs (which we might not get back) made it difficult.

    We went to a long lunch and came back to discover they were half moved so started putting our stuff in rooms as they moved stuff out. :mad: The garage was well packed as well. Eventually we moved their remaining stuff out and left it on the front lawn to collect and locked the front door from the inside and parked a car up against the garage door so it couldn't be opened, then went to hotel for the first night.

    The next day we started gutting the house which took 3 weeks, every rooms had to be replastered as kids had run riot whilst unsupervised.:eek: New kitchen, bathroom, loo, boiler, fuse box, garage roof......... then we ran out of money but at least we could live in the house instead of camping at in laws.:(

    11 years later we have nearly got the house completely done.

    It's okay to worry a little - it is a human response to chaotic events outside our control. Within reason it is a useful survival and coping strategy.

    A while ago someone posted here whose vendor changed there actual mind between exchange and completion. It's not exactly the same but have a browse. First - remember that this is the absolutely worst case scenario, so this hopefully can help you set limits on your stress levels. Also, please note how many posts there were saying how rare and unheard of it was. And it will occupy your mind instead of worrying.

    Also, I can't find the Dead Great Dane thread or the caravan in garden thread. Some kind person may linky. They are completely irrelevant but highly entertaining and will in huge gaps of time that would otherwise be spent worrying.

    Have you actually exchanged contracts, or are you exchanging and completing on Friday?

    We have exchanged contracts (last Friday), it was supposed to be earlier last week but the vendor forgot to drop his contract back to his solicitor twice that week!
  • The key bit will be completion and ensuring money has transferred. Once that has happened it is your house and teh contract will specify completion with vacant possession or similar. So if you do find yourself in the albeit unlikely position of not having vacant possession and no keys then yes you technically could get a locksmith or even call the police, as the vendor will be trespassing on your property.

    Obviously rather extreme but nothing wrong with wanting to know your rights in advance if its been a difficult transaction so far. I would be tempted to ask for a pre completion viewing to ensure all is as it should be to be honest.
