Indemnity Insurance/Remedial Work

Hi, I'm in the process of buying a house that has an extension that does not comply to building regs (it has been standing for over 25 years). I have been advised that my conveyancer will probably request an Indemnity Insurance Policy from the vendor for lack of building regs.
However, I would like to do remedial work to bring it up to standard to enable me to use it as a kitchen (currently a toilet/utility/family room)
As far as I understand it, the Indemnity Insurance policy should not be advised to a third party, especially not the council planner/building control as they will then be 'on notice' (although it is unlikely they would be interested due to extension being so old and not in an unsafe condition).
So I was wondering how I would go about this if I can't bring it to the attention of building control - or does the fact that I am bringing the extension upto standard mean it kind of nullifies the policy and once the building control are happy then no problem?
Hope someone can help/advise and any information very much appreciated.
