Potential netbook mis-sold at Argos

I'm hoping I've posted this in the right thread as I wasn't quite sure where it fit.

I bought and received a netbook from the Argos eBay outlet this week. I thought I was getting the Acer Aspire D255 but what I received was the Acer Aspire Happy-2DQgrgr.

I thought they had sent me out the wrong one but on looking at the listing everything that I had got was in the description and it looked like the one in the picture. The only thing that was wrong was the listing title.

Now I'm a pretty tech savvy person and had done my research so I knew what I was getting. The only thing I didn't know was what colours the D255 came in so when I saw the listing I thought I was getting the correct one just in lime green. Annoyingly Acer seem to name their netbooks with very similar names and with very minute spec differences.

I've emailed the Argos outlet twice to say that they are mis-selling the product as being something that it is not. They just replied with a polite note saying that they have contacted the listings team to see what was put on but there wasn't much they could do at the moment except collect it off me and double check.

My question that I'm asking is that I'm not sure what to do next. I go on holiday next week so haven't got time for them to check and faff around. I think I can live with the laptop that I've been given as the spec will probably do what I wanted (It's only a single core processor and no capacity to upgrade the memory). Saying that though I've not powered it up yet as I wasn't sure about returning it. I've made the complaint more for consumer rights and to stop people who have less computer awareness being mis-sold.

Sorry for the long ramble.

    Personally I'd send it back, it'll be significantly slower than the one you payed for.

    To be fair, at one point all netbooks had strange naming schemes despite almost no differences other than build quality/outside appearance. Just basic 10", crappy Atom, 1gb memory.

    Now they are starting to be differentiated by dual-cores vs single (or AMD fusion chips), screen size 10"-12", battery life, and some even have decent graphics cards.

    All the retails are rubbish at putting the correct basic details of computer products on their websites. When I was looking for a new laptop I ended up doing my research by looking for the manufacturer product code as it was the only way of knowing what details were correct or not

    Just bought a machine from them. Happily for me, the spec was better than the one advertised. They don't quibble about the return.

    Of course you can upgrade the RAM, just replace the 1GB stick with 2GB.

    Only if the motherboard will allow you to do that.

    Just checked the machine's specification. 1 GB RAM max. Perhaps best to swap the machine..

    I've been having a look on the web and it seems that the higher spec comes at a much higher price. I paid £150 whereas the higher one is gone 200. I guess you get what you pay for. the similar spec for the d255 is the same price as what I paid for the happy.

    Has yours a 3 Cell battery or 6 Cell?
    They have a Dual Core D255 for £174 and a few more within your original budget.
    I honestly wouldn't stick with a machine that took 1 GB RAM as a maximum.

    They're sold cheaper via the eBay outlet as they are refurbished or goods returned under the DSR. They will be able to find stock no problems if you have it replaced for the far superior model you paid for.

    Obviously it's your choice and your money to waste, but know that the Trade Descriptions Act is pretty clear about where you stand.

    This one is the 6 cell battery - I made sure of that.

    This one was listed as brand new...which it was as it had the Acer tamper proof stickers all over it.

    Normally I would be really militant about returning it but I bought it for my holiday which I go on next Tuesday so I don't have any time to look for a new one and get that delivered. My only option is to buy in person. RussJK - unfortunately I didn't pay for the superior model, I paid for the one I got, the description were correct but the listing heading was wrong but as I thought I was getting the D255 I thought the memory was upgradable.

    Hmm I wish I was more decisive.
