  • So how can i get these debts cleared if I cant move please help we have had many a sleepness night worrying about this. If the all the debts are put on the home can they force the sale of the home to pay them.

    Why do you need to stay in the house?
    You dont really have much option. You are in debt by quite alot.

    ive had the house changed to help me get around. I really cant go through the stress of moving.

    You dont have much choice. The debt will always be there and will need repaid. How else are you going to repay it?

    What you want is for your uncle to clear the debts for you, your uncle 'buy' the house and settle the mortgage and then rent the house back to you, whereby Housing Benefit would be paid to your uncle.

    Lets see who gains.
    You because you will no longer have any debt, you because you will still stay in the house, you because it won't cost you a penny in rent. Not forgetting that what you used to pay in mortgage payments now becomes spare income.

    Then we have the uncle, he obtains a property at below market value, but he has to pay for it - err does he? No not really because the housing benefit will be used to pay the mortgage.
    So in reality it isn't costing him a penny either to have an ever increasing asset.

    So who the **** is losing out then?
    Somebody must be paying for this.

    Oh yes the taxpayer. They will be paying the housing benefit to you for your uncle for him to pay his mortgage with.

    Bankrupcy is your best option and find somewhere else to rent. Many do it and have no choice, what makes you so special?

    He can buy it yes. But then you wont be able to claim meny benefits as technically you will have alot of money. As even though its been passed over to the mortgage lender you will still be seen as having it. So benefits will be stopped and you wont be able to claim help to pay the rent on the house as you used to own it.
    So yes he can buy it but you will be in the same position you are in now - infact even worse as benefits will be stopped.

    what would happen if the debt companys force me to sell. then we will all be homeless

    why not get your uncle to clear your loans for you?
    Then you can pay him back with the repayments you would normally make on them and your house wont need to be reposessed.

    If selling the house covers all the debts and gives you a clean start then theres not much choice is there especially as your adding to your outgoings by adding another member to the family.
