And don't be put off by sangiar's (or whatever his name is) experience. People are a lot more likely to post here about bad experiences than good ones.

I see PRR under Sangiar's name. Therfore please do provide as much evidence as you can and take that poster's personal experience out of the equation ;)

Independant, unless of course, its an ATOS doctor on the appeal panel.... Which is a possibility, although they are not sitting as an 'atos' employee, I find it impossible to see how they could be unbiased if employed for atos, trained by atos, and then claiming to be putting on a non atos hat for the day...

Not all doctors on the panels are atos employees, hopefully the likelyhood is low that it will be.

I hear what you are saying but DLA focuses on what a person cannot do, not what they can like ESA. I think the likelihood is low, and either way, it is not just that Dr deciding.

Thanks for all the replies. I called today and told them I'd like to attend the hearing, I also called the CAD and made an appointment with them.

Hoping they'll be able to help me prepare.

Thanks for the advice. It's appreciated.

I would mention that from experience of 'losing' at 2 Tribunals and now awaiting a 3rd. No one is interested in 'evidence' that describes your condition, how it is treated or what the prognosis is. The only evidence that is required for DLA (as told to me by one Tribunal chairman) is substanial medical proof appertaining to the descriptors of DLA. They need good evidence of your ability to walk, how you walk, how long it takes to walk that distance as well as what happens if you walk.

Anything to do with a diagnosis is useless, you require the evidence to back up what you say are your care needs and what mobility problems you encounter.

I handed over pages and pages of medical reports from the Consultants and clinics that care for me. None of it was of any use.

And you should not 'put a show on'. Using your stick when it is not needed at the time is deception. They want to see how good some of your days are as well as those that are bad.

I'm in the same boat, only difference is that I never appealed against my refusals. They keep on using a 2009 ESA report against me which said that there was nowt wrong with me.

You just know when you won't win!

Good luck, I couldn't think about doing what you are taking on.

One and the same person.

OP I am pleased you are attending - let us know how it goes.

My wife and i recently (Monday) had the appeal for our sons DLA for his Autism, he was initially refused over a year ago when he was 2. We immediatley appealed and have waited over a year for this date.

We had to prove in his case, how he requires extra care above and beyond a normal 2 year old.

We was questioned quite in depth by the 3 on the panel, my wife had it in her head we would lose as not many 2 year old are granted DLA for autism...however...we won the appeal.

He has been awarded the highest level of DLA for his care and backdated to April 2010 (owing us just under £5000)

So go, you need to justify unfortunately and by going you will know you did all you could.

Consideralso that you are being used as part of the statistics to claim that 'x% of people applying are not eligible for benefit'

you have to understand that there are lots of people that couldn't cope with doing that. If I'm anything to go by, when I feel stressed, angry, upset or uncomfortable I am just as likely to hit someone. I have a track record of doing that which is part of the symptoms of mental health issue I have.

    It's not just that easy.
  • Anyone attending a doctor's examination,or appeal or whatever, should bear in mind that it begins when you walk through the door. i.e. your demeanor, walking ability, etc, will be noted by the receptionist, and passed on.If you ask for travel expenses, then stand at the receptionist's window to complete the form, that will be passed on.So don't be a hero,if you need to sit down, take the form with you,and return it when you've finished.Consider that the event has started once you arrive there.

That is wrong! What has that got to do with my illnesses? I am honest, and to suggest that I should play some game pretending not to be able to walk or something is wrong, really wrong.

If no one can see what my problems actually are without acting a stage part then the whole thing is wrong.

There is no way I am going to be anybody or anything iother than myself, good or bad.

If some one wants to take issue with that they had better not voice that to me in person.
