Orange upgrade issues

Hi all,

Looking for some advice with my current Orange contract.

I upgraded back at the end of May to the Atirx which came with the free Work and Play kit (about 140gbp worth of equipment)

over 3 months on and I haven't received the kit despite countless phone calls and told each time to expect it within 10 working days. I was even once incorrectly sent to a store to get it, they have nothing to do with internet upgrades though.

I am now trying to cancel the contract however Orange are saying that the work and play kit is not part of this contract (free gift) and as such does not qualify as a reason for me to terminate early.

Do they have a point? I thought this could be seen as a case of misrepresentation, am I wrong? Does that not cover free gifts such as this situation?

    I think they don't have any point and are having a laugh. The gift clearly was a part of the contract and Orange failed to fulfil their obligations.

    Q. Can I cancel with the network?
    A. Annoyingly you can’t simply cancel your mobile contract because the terms of the cashback deal have been broken. This is because the cashback contract you agreed to was not made with the network provider (02, 3, Orange, TMobile, Virgin, Vodafone) but with the retailer; you have a separate service contract with the network.
    The above was for a different case when another company had to pay the cashback.
    In your case it is the same company, i.e. Orange, and not a separate contract. And I don't see much difference between a cashback and a free gift.

    I can't advice on the course of action, but I think it's Orange internal complaint procedure to start with.
