Jacobs Bailiffs CONCRETE HELP NEEDED PLZ X

This is my 1st post but I need some concrete info regarding Jacob's balliffs and a unpaid PCN, which may I add is in my husbands name not mine.
The balliff office sent us a letter to our old address before we moved stating that a balliff was going to call, so I therefor rang the office to try and sort this out, not once did they ask my husbands authority for me to speak to them, and they said sorry we can't do anything, you have to wait for the balliff to visit, I protested as this I knew for certain would mean "costs". No they were adimant we had to wait, the balliff then visted 3 days before we moved house, my husband was not home, but he spoke to me, saying if it was paid that day it would have been £200 and something odd but if it was paid after 23rd july 2011 it would then be £313, which is the price I assume we now have to pay, we claim benefits, and have children all under 12 to support, I said to the balliff that we would pay £105 for 3 weeks to clear the debt, stupidly I know as we couldn't afford to do it, I have since received 2 texts and 6 missed calls from the balliff. HE HAS STILL NOT SEEN OR SPOKEN TO MY HUSABND!! I called him again on friday and told him the amounts we had to pay were stupid and would have put us in server hardship, he was not very polite, and told me he was sending a collections team on monday (which is tomorrow) I agrued that nothing in this house belonged to my husband, as I had all the belongings before we got together 5 years ago and the tenancy for the house is solely in my name, still he was not very polite, I then said that we wanted to pay in anstallment plan, as advised by the C A B, he told me that Jacobs don't go by C A B rules/ referals. So I said what am I supposed to do to the reply of I want £100 by monday (which is half my weekly income and yes I have put it away just in case) then £50 a week thereafter!!

I have been told that Jacobs do do payment plans for PCN's as do Rossendales and they are brilliant, had dealings with Rossendales before and they have been nothing but helpful and polite, but Jacobs are in a league of their own!!

We have 5 children, and the face of hardship is terrifying me :(

I don't know what to do and they can't take my husbands car as we have sold it anyways!!

    DO NOT PAY THEM BUT YOU MUST GET GOOD ADVICE. HIDE THE CAR THAT RELATES TO THE PCN, SOMEWHERE OFFSTREET AND OUT OF VIEW, NOW.

    Is this all about just one Council PCN? Not a private fake ticket, a real Council one?

    If it's a real Council ticket, quickly go to BailiffAdviceOnline and join and pay £10 for urgent advice. It is worth the tenner because Sheila knows her stuff and can look at those charges for you, hopefully spot any unlawful amounts etc. Do not just look at the website, go there and get personal help. Others have always confirmed on these forums that they are brilliant at reducing bailiff bills and even geting bailiffs called off. They will act very quickly to help you.




    P.S. Why are you saying Rossendales are brilliant, do you mean you have paid a bailiff before without taking advice? Reports online have not said they are brilliant, allowing a payment plan isn't a good thing if the charge is extortionate!

    P.P.S. Next time either of you get a Council ticket for goodness sake take online advice at pepipoo forums and appeal it successfully, then you pay NOTHING.

    Car has been sold and no where near our property, Its a council ticlet, received when visiting our MP's office, have paid rossendales for unpaid C/T.
    Only money I have is to pay bailiff tomorrow if needs be :(

    Have signed up, awaiting reply, just dug out the only 2 I REPEAT 2 letters we received from Jacobs, 1 from the office, the other from the bailiff himself!

    the 1 from the bailiff doesn't even list costs, is this normal pratice?? There was me thinking I was clued up, just goes to show ur not as switched on with things as u think.

    They must give a costs breakdown if asked.
    According to the Traffic Enforcement Centre the bailiff must also carry a copy of the warrant and present it when asked. I very much doubt that they will have a warrant with them.
    "The certified bailiff must have the warrant in their possession when
    they visit a person or premises with a view to enforcing it. The warrant
    must be produced on demand to anyone who has reasonable rounds
    to see it."

    Do not me misled by the 'certified bailiff' - they do have to be certified to do this work but they operate as a private bailiff when doing it. They will turn up and tell you "I am a Court Bailiff' and they are - but they are not acting as a court bailiff and there is a world of difference. If they say they are 'from the court' or that they have a 'court warrant' they are being less than truthful in my opinion.
    Record any encounter with them.

    You will be in excellent hands with bailiffadviceonline in my opinion.

    Their charges come under "The Enforcement of Road Traffic Debts (Certificated Bailiffs) Regulations 1993", you need to factor in the latest amendments.

    I do not believe they have any right to distrain on you.

    Record all contact with bailiffs, especially with the regard to CPE enforcement.

    If you pay them even just five pounds you have agreed to the debt so do not pay them a penny if you are disputing.
  • I have done some digging on the net, found some great info and email addresses :) I am going to complain about the bailiff I have been dealing with, just my complaint is going to Paula Jacobs & Simon Jacobs - owners of the company and Pauline Mansell the companies Bailiff Manager :) have copied and pasted their mission statement in there to just to remind them of what they have said and how they act, which I am sure alot of people on here will agree is not the way their employees act EVER!!

    Am waiting for bailiffadviceonline to get back to me, I am also going to go to the C A B 1st thing tomorrow morning.

    If you have moved and you didn't receive the PCN and the Notice to owner

    ring the Traffic Enforcement Centre on 08457 045 007 You will need to give the parking ticketlink3.gif number and you must ask them to CONFIRM the precise address on the warrant if the address is your previous address you need to fill in a TE7 & TE9 form and state on it something along the following lines:

    I was unable to file this statement within time because it was not until a bailiff paid a visit to my present address that I was made aware that all statutory notices had been sent to my previous address at ( put previous address).
    I am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites


    If you are in any doubt please seek legal/expert advice help

    we received the PCN and notice to owner at the old address :( but that would still make the warrent valid at the old address not the new 1

    If the PCN and NtO went to old addresses, both of you above, I think you should ring TEC now and ask to file an 'out of time declaration' (I think that's what it is called, someone slap me if I am wrong).

    You may be wise to both start a new thread on pepipoo for help with this. It is possible that one or both of you can get the bailiffs called off completely if you get your OOT accepted; the Council will then probably refuse and then I think you fill in another form...and the case can be re-set back to NtO stage in some cases. That would then mean you are back to almost square one and pepipoo can then help you appeal and (hopefully) get off said PCN like most people who go there do!

    But I am not an expert on this procedure so post on pepipoo here today once you have registered and got a clearance email to post (it's free advice on PCNs):
