mortgage vs renting

I am stuck in a catch 22 situation and need advice, own my property with partner and we have 2 children, anyway relationship is dead in the water and he wont leave, i want to sell flat as we have around £120k in equity but if we split this, i would have to house myself and 2 kids and he would not, does not see fair to me to get 50/50 of this equity and yes I could go to court but how long would this take and cost !, I also had a CCJ for about £700 a year ago which gives me a bad credit check so am afraid if I do sell up I would struggle to buy or even rent by myself....any ideas ?

Keep the flat, kick him out, and offer to buy up his half.

50-50 sounds as fair as you can get, unless you paid the mortgage each month or put up a larger part of the deposit when you bought it? Either way it is academic, the courts I am fairly sure would award an equal split under common law. Sorry to say but there is probably no easy solution to this, reconciliation out of the question? Or perhaps he should stay in the flat, buy you out and house the children?0
