  • also i think we would rather wait to cancel the insruance policy get the refund and pay with that if it absolutely comes to it rather than pass it to the insurance not be able to cancel the policy not get a refund and pay the policy for another 4 months until the end, despite not owning the car since april! what do you think?

    no, the opposite direction.

    Was there any parked vehicles on the road or any obstruction that would require that vehicle to transverse the white line on to the opposite side of the road,

    So he was on the wrong side of the road, approaching from her left, going 20mph over the speed limit?
    Was he passing a parked or stationary car maybe?

    Considering she put herself in the position of having an accident, she saw an awful lot (wrong side of road, +20mph) but she still pulled out in front of him anyway?
    That's suicide isn't it?

    The Op hasn't fully described the accident but I gather the circumstances were that his wife turned right into a major road from a side road.
    A BG van on the main road was approaching the junction from her right, he saw her pulling out and went to the other side of the road in an attempt to avoid a collision.
    She carried on because for what ever reason she didn't see him and a collision occured.

    If I am incorrect perhaps the OP can give more details.

    i dont think there was no, all i can assume from what my wife tells me of the accident is that he was speeding and thought that he wouldnt be able to stop before she had pulled out therefore crossing over to the other side of the road thinking he was going to hit her, but she had had time to pull out entering the correct side of the road. (also there isnt the normal broken white lines on that road they are the diagonal white lines that are in a box with a solid white line on the outiside, soz dont know what these are called and its the best way i can describe them)

    It will depend on if the vehicle was overtaking stationary objects or vehicles, if not and witnesses verify this then and to road is wide enough for two vehicles or better still has white lines no, the other driver can not hold your wife responsible .
    If the road was clear, she exited a turning on to the correct side of the road with her vehicle under correct control then the driver travelling in the opposite side of the road has lost control of his vehicle, left his side of the carriageway and collided with a vehicle been driven in a responsible manor under necessary care and attention.
    roads have white lines for a reason.

    Now, did you inform your insurance that it had been involved in an road traffic collision .
