02 contract problems/get out

My origional contract was for £37.50 (inc vat) and this was to include the following.
Tarriff: £25
Unlimited wi-fi - £5
Insurance £7.50
The contract is for 24months I got my phone on 15.12.10, and I dont think i have ever actually paid the £37.50.
Feb-£43.84 march 42.55 april 51.85 may june similer july 49.47 august 52.55
On 19th April I went onto the 02 website and spoke to an online assistant to remove the insurance and the internet to reduce the price to 25. but they are still charging me more than my contract.
On 15 July we rang customer care who explained we were being charged that much because i had a smart phone which uploads information from the internet even when i wasnt logged onto the interent it would charge a pound everytime and this would upload info a couple of times a week which is why its so high.
said he would reduce my payment to 29 (inc vat) for basically the same package i had before but they have not done this as i got charged 52 last bill. want to get out of contract now but not sure how

Hi, none of the complaints you mention are reason to be released from your contract.
I do not think you have any way out of this contract other than paying it off.
They have explained why you are going over so take measures to rectify this.
I don't know which phone you are using but with most phones you can go into the settings and set it so that it will always ask you before connecting to the inernet. It sounds as if you have got it set to connect automatically.
I don't mean to sound harsh but if you read through all the posts about getting out of contracts you will realise that you have little chance of ending the contract.0 -
Switch the mobile internet off if you don't have it included in your tariff and don't want to pay extra.0

I really can't believe your initial post!
This may sound harsh, but I never cease to be amazed at the number of people who come on here after getting smartphones and then find that they have large bills, either because they have hit roaming data charges or because their smartphones access the internet in the back ground.
And why do they get caught? Because they didn't read up on how the devices work!
And, of course, it's never ever the OP's fault. Your post actually is saying that you don't know how to configure your phone , you don't understand the basics of smartphones, you probably got it because it looked cool and it's O2's fault, so you want to cancel.
Learn about your device, decide what facilities you want/afford or sell it, get a basic Nokia and put the sales proceeds to your monthly bills.
Edit:- However, re-reading, you really need to know why the bills you had when you had unlimited internet were so high. The first one I can understand as it was probably not for an exact month, but unless you were caning the data, the cause of the higher bill is a mystery. If it was for o845 numbers, then that will still be the case.
You should re-instate your £5 for the internet if you can as that is one of the real reason that separates smartphones from basic ones. And keep within the limit.0 -
