Wth? Landlord "added" me to my SO's current contract but just noticed >>

that the new one is a brand new 6 mth contract - SO has been here for a year and 6mths was up and then it was a month my month thing with 1 mths notice.

Now in the new contract it says we need to leave 2mths notice to leave?

Ugh. If we had known it was a brand new lease we would've just not bothered with it and got a new place.

    No idea what you mean. You've signed a new tenancy agreement without reading it first and now don't like the terms?

    Or you've been offered a new 6 month contract but don't want it as you are happy on the existing monthly periodic tenancy? In which case don't sign it!

    Don't really understand your post. Are you saying you have signed a new 6 month fixed term tenancy agreement? If so, you are bound for the full fixed 6 month term, not just 2 months notice.

    However, if you haven't signed a new contract, regardless of what your LL has given you in the form of the lease, you haven't accepted the new term, so will still be on a periodic tenancy.

    Please explain a little more clearly what you mean and someone may be able to advise on your position.
  • If no-one has signed this new agreement then don't sign it. People can't just be added to an agreement without their consent. It's usual to have the new person credit-checked. Did you give your consent to that?

    In any case, moving out at the end of a fixed-term requires no official notice to be given at all. For a rolling periodic tenancy it's one month regardless of what fancy clauses they might try to write into the new agreement.

    Well, my boyfriend had been here 6mths and had finished his contract, I moved in and the LL asked that I be added to the lease for insurance requirements. He said that I would just be added onto the current contract which is a month to month contract, so that if/when we wanted to move out we would be required to leave 1mths notice.

    Just fished it out and he's added a whole new 6mth contract. FFFFFFFF. This sucks. There's a waste pipe going through the living room and this is why we want to move out cause it's damp, and it stinks, and there'sf lies everywhere (other post here : https://forums.moneysavingexpert.com/discussion/3373044

    Ugh. And yes we signed it when he came over to watch the workmen pull apart the living room! FFFFFF
  • You can't be "added" onto the current tenancy without having a new agreement drawn up. Now that you've signed it you're committed for six months. Bad luck.

    Get Environmental Health involved if you're not happy with what the landlord is doing to address the problem.

    There in lies your problem - NEVER sign anything without reading it first. Whether your LL intentionally mislead you is your word against his. You signed it, its binding.

    If you have issues with the property, this is a whole different situation. Raise the problems with the LL and ask for him to address the pipe/fly situation. Put the problem in writing, of you haven't already done so, and give LL a timescale to address it. If they don't take it further with EHO. However, I find it difficult to understand that your partner has live there all this time and accepted the pipe situation, without any issues. Why has it suddenly become a problem?

    Sadly though, you signed contract and have to live with the term you have accepted. Failure to read and understand it is not your LL's problem.

    Good advice - except no notice is needed! OP and partner can just move out without notice as soon as the 6 months is up.

    Does that mean you got the contract back out of the envelope.

    If you still have the contract, just dont send it back and shred it.

    SO moved in. Signed 6mth contract - it was then a rolling contract.

    I move in, added to contract.

    A month later, they remove the wall to gain access to the waste pipe.

    4mths later, it's still there with no progression due to council taking their time

    SO and I want to move now, thinking we were on a rolling month contract, but apparently we have to give 2 mths
