Returning an Xbox360 - what are my rights?

Hi All,
Apologies if this is in the wrong place. I've scanned the forums to try to find where to put it, I'm hoping people on this board will know that answer.
I bought myself and Xbox360 through Gamestation 4 days ago. For a number of reasons I no longer want it. The primary reason is that I'm very unimpressed by the online gameplay of Pro Evolution Soccer and some of the other games - if I had wanted lag I would stick to my PC !! It's just not up to the quality I thought it would be.
Do I have any legal rights to return everything for a refund - or am I stuck with taking a big hit on Ebay and selling the whole bundle ?
Obviously this is not an advery but if anyone is interested........

I recently returned my sons Xbox to Game (it was faulty, kept freezing)..no questions asked, just took in receipt and it was replaced....they didn't even test it!
I'm not for one minute suggesting that you take yours back and ask for a refund stating that it is faulty!This post was created in an area that may contain nuts!0 -

I purchased nokia N-gage from game station it became faulty after several months although I had my receipt they would do nothing about it because they no longer sell phones!!!
I read them the riot act....politely ... and emailed head office TWICE they dont even bother to reply!!!
SO WILL NEVER GIVE MY CUSTOM TO GAMESTATION ....Good luck...I would love to be a Travel Agent :j0 -
I appreciate that this may be possible if the item is faulty, which it is not per se, but i don't believe that it is performing as I would expect it to, Xbox Live seems to be more like Xbox almost Live most of the time.
Is there any legal advice on what my rights are for seeking a refund ? Out of principle I do not wish to lie to the shop, I'd rather take a hit on Ebay.

Unfortunately, you have no legal rights TBH. Lag on the internet could either be your internet connection or the connection of those you are playing with. Microsoft's Live terms and conditions do state something about lag, can't remember what the exact wording is, but there's something.
Once its been opened, and played with it becomes worthless to the store. A faulty one is more valuable, since they return them to the manufacturer and are sent a brand new model in return. Returns policies always state that the item has to be un-opened and in its original condition. Looks like eBay then. I'd suggest local papers too. eBay fees are so high.~Diminutive0 -
Xbox Live is fine on mine... no lag or anything... It may be your broadband connection?

Pro Evo is the worse game for lag on the 360, Its a game issue (or network issue) and certainly not a 360 issue, so they 'might' exchange / refund the game (i doubt it though) but id be very suprised if they let you return the whole package.0

Does sound like your connection - mine is connected wirelessly and Pro Evo is spot on (apart from when a torrent is downloading!)
Your only hope is to argue that the Xbox is not fit for purpose. To do this I would expect you will have to research the minimum requirements for running Xbox Live (operating system, broadband upload speed etc) as stated by Microsoft. If you can then show that you have the minimum requirements then you should be able to argue a refund. I don't fancy the battle you have ahead of you though.
Personally I would look at tweaking my set-up - honestly, there is a reason Live is so popular. After all there aren't thousands of us out there putting up with game lag because we have to!0 -

The lag is to do either with the game being programmed poorly or more likely your internet bandwidth not being very good at the time you were playing.
Unfortunately, you can't really return the item. What you're asking for really is Gamestation to take the hit instead of you as they can't sell it new either. That's not really fair.

Oh, and if you do decide to eBay it, they still got for almost full RRP, even if they're second hand, so you shouldn't lose out too much.0
