PRC House Certificate missing?

Good morning people, I have a bit of an ongoing problem at the moment. Let me explain.

I bought my house in 2009 from a private owner that bought it from the council in 2004 under the right to buy scheme (ex-council house).

I had a home buyers survey done, which was checked over by my solicitors and everything went ahead as planned. I was accepted for a mortgage and i moved into the house in Feb 09.

However, I am now trying to change my mortgage to a let-to-buy mortgage to release some equity in the house to put down as a deposit on a new house so we can live in the new one and rent out the current house. It turns out that I cannot get a mortgage on my current house because it is a non traditional build house, PRC build Airey house that has been repaired (refurbished) but, apparently, not done to a mortgageable standard.

I have spoken to my solicitors to find out what is going on and they said they couldn't find a certificate of the work or it didn't exist. I have since spoken to the company that did the work and I have a copy of the certificate being sent to me, however it does state on the certificate that the work had not been done to a mortgageable standard.

I have sent a letter of complaint to my solicitors asking why I was sold this house when it wasn't mortgageable, why I wasn't told about the problems I would have in the future and why they didn't either find a copy of the certificate or advice me not to go ahead with the sale because there wasn't one with the property, especially as it clearly stated on the Homebuyers Survey "Your legal advisors should check that a certificate exists to confirm that the property has undergone an approved pre-cast reinforced concrete refurbishment scheme” which they didn't do.

Where do I go from here? Am I right to suggest the solicitors have messed up by not finding this certificate and also, in my best interest, informing me of the problems of a non traditional house.

I must add that I was a first time buyer and had NO IDEA what a "non traditional build" was or any problems with it, and not once was it highlighted to me that there might be problems here.

Any help would be very appreciated, and i'm sorry for the long post :(

    It's only a problem for most mortgage companies. There are 1-2 companies that would consider a mortgage on a non standard construction, so you need to find a Whole of Market good mortgage broker and go directly to them with that query.
