    GM - in repsonse to your post - yes they had an EPC as the house was on with letting agencies before they rented privately and yes they have gas safe certificate.

    yes they got consent from their morgage company.

    Whilst i agree the tenants are also homeless - maybe if they knew how to acutally look after a home they would have a bit more sympathy from me.

    My friends know they have been stupid, and I am trying to do is to try and find out the best way out of this mess. Whatever happens they are not nasty people and they do not deserve to have their home trashed nor do they deserve to be threatened or harrassed.

    also there is an assumption here that there is benefit fraud going on simply because the woman got hb and the man paid the rent. it is possible for her to claim with a partner and get benefits and work at the same time.

    i am a LL of 12 years, and most everything that has been said up to now is correct. Your freind's cheapest way to get this dealt with properly is to contact Paul Shamplina - google him - he gets tenants out for a living and is a lot cheaper than any solicitor... He has evicted thousands of tenants and is THE expert He will not judge them, he will give a fixed price and he WILL get them out. He is a veritable terrier with rubbish tenants... ASolicitors will never give you a fixed price for eviction work.

    The last court i attended to get a tenant out, an earlier hearing landlord told me that the judge had said to his own solicitor that he thought his fees were outrageous and that he should reduce them !!

    I did say "think" about benefit fraud! and she claims that her and her partner have split up when he is the one sparodically paying the rent
