    Fingers crossed they don't go to the council (which they might do to say they have nowhere to live) the council will ask questions then the sh_it will hit the fan.

    Getting someone out takes time. You cant just chuck someone out. You need to serve notices, go to court, and then get bailiffs in. To kick someone out without a possession warrent served by bailiffs is a dangerous game.

    Will the council have something to say about the fact this woman is claiming HB yet my friends were never paid from that and it was the BF who paid the rent as and when and never the full amount??

    All i know this is going to get very very messy...........................

    I hope your friends are OK and i appreciate this is not normal for them but any threats of violence or vandalism your friends must tell the police and show them the texts - irrespective of all the other factors.

    Well, *if* they go to the council, the first thing the council will ask is "Why are you homeless? And why did you not tell us about the court hearing?". Regardless who is paying the rent (the council will probably have a go at them, sanction them etc if the council have no idea about the partner) if they go to the council, she is in deep faecal matter.

    The very least that will happen is that the landlord will be forced to let them back into the property. At that point, you then follow the correct procedure for getting them out.

    At this point in time, i'd be tempted to give them the keys, tell them to get in that flat and shut up, then serve a section 21. and don't do anything that they think is clever like un-wiring the plug sockets, turning hot water off etc. Satisfying - yes. But won't do any favours.
    If at first you don't succeed; do something else.

    Yes I have told her to keep proof of all the texts etc .

    I have also said let them get their stuff out - but to make sure they always have someone else with them in case anything should happen. and hopefully if they get their bits they might just leave them alone - but some how I think not.

    I feel for them so much - they are a young couple just had a baby a year back were struggling so moved back to her parents - rented the house out so they could save up and move on - and it has all turned to rubbish...........

    It depends on the length of the notice. But if one has been served already, then it might be an idea to run down the courts as it should still stand, and then get a hearing date. but there will be a bit of a wait for that. The sooner the better.

    Ask her to consider getting the tenants done for identity fraud - you already know where they're living ;) Consider that avenue, as they have used her name to get services. I would.

    she is coming round tomorrow with the paper work so i can have a proper look.

    No she turned the utilities back in her name the moment they changed the locks - maybe not such a smart thing to do.

    She has just sent me a text - apparently the council know what has happened and they are waiting to hear her and her husband's evidence as to why they did what they did............................

    I'd be tempted to bluff this one out. Something along the lines of "we changed the locks to meet our insurance t&c's and we left a note on the door for you to contact us for the new keys. Did you not get it?"

    Unless of course there is a text saying something along the lines of "I changed the locks, goodbye..." on the tenants phone.
