    Taken for a ride I'm afraid. Taking nothing else into account as a previous poster mentioned they are paying UNDER the minumum wage...

    Thank you for the all the responses, I think you have all confirmed what we already knew!

    I think the other thing that doesn’t help is that my partner has the worse case of dyslexia.

    Even spelling his name can be difficult. However, Like I said in the above post, This has never affected his working life, Just his confidence.

    As we speak I’m going to write him up a cv & when he comes home we shall go on the hunt for new employers.
     

    Good idea. better than reporting partners brother to authorities or taking him to court as others on this thread have suggested.

    Yes because employers should be able to live under different rules than the rest of us shouldnt they.
    You seem very insistent that he doesnt report him. I wonder why!!!!
    Mistral i am willing to bet that you would NOT apply those same principles to benefit fraud.
    You would be humming a different tune then i bet!

    There is no use talking about the law unless you are willing to take action. It is irrelevant in this particlar situation as the OP will not take the brother to court or call in the authorities. It needs to be sorted out within the family.

    The employer should be reported ASAP for what they have done, anyone who says otherwise should be very ashamed - employment law exists for a reason.

    No I do not know the OP. Looks like I just assumed the brother part - I see the OP did not mention it. Sorry that was my mistake.

    Thats the great thing about NMW reporting to HMRC it can be anyone that did it and they(HMRC) can even investigate off their own bat if they think there is anything wrong.

    They will also have a good look at the rest of the business for dodgy stuff which I would guess will be there.

    Stiffing your own family, do them big time.

    My first summer job(seaside hotel,cafe etc in cromer 30 year ago) got raided every year because they were known to be dodgy, employing underage and under min wage, they often got away with underage they got them to hide in the cellers and paid cash, I got under min refuned because I was on the books and they made the wrong deductions for accomodation.

    If your OH does move on, which hopefully he is able to, then be sure to leave the boss in the lurch as badly as possible. It's no less than he deserves.

    Don't be such a baby. Nobody is saying that family members should be allowed to get away with criminal offences or even underpaying.

    The point is that if the OP wants to report the lack of minimum wage etc and is happy at the resulting huge family fallout then absolutely, go ahead.
    Most people do not want to be at daggers drawn in a huge family feud and therefore it is not wise to report them or demand your rights unless OP will be happy with the consequences which will certainly follow within the family.

    The truth is that in family feuds, there is no due consideration usually of right and wrong, there are just sides being taken, and they are taken for an extremely long time.

    Saying it would be ok to leave the matter alone is allowing the illegal behaviour to continue, surely?

    If a member of my family was treating someone illegally eg not paying them minimum wage, illegally docking wages, or whatever, or if I found out they condoned this sort of activity, I would report them ASAP and avoid further contact with them - they would be clearly scum and not worth wasting further time on.
