help needed urgently

I have got on credit some christian books, dvds, bibles etc from STL Distrubution and I am outside my 7 days for me to return them. I want to return them but STL are saying I cant because i am outside my 7 day return. Now they are charging me for the products and I havnt sold them and I need to return them some how.

Is there anyone out there who can help me of what I can do?

    Did you tell them you didn't want them within 7 days of receipt?

    Assuming that they don't have some returns policy (e.g. return unused within 28 days for a full refund) then they would appear to be complying with the Distance Selling Regulations and as such are behaving perfectly legally.

    Also assuming that you didn't tell them you didn't want the books within 7 working days following receipt (you don't actually have to return them during this period), then I'm afraid you have no legal redress. You can't expect a refund simply because you've changed your mind.

    Its not a case of not wanting them, its a case of them charging me for them when they havnt been used and they are sitting in my garage waiting for them to collect them! There must be someway of returning them. If I havnt sold them - the idea was to sell them online but they havnt been sold online so therefore I should be able to return them and not be charged!

    Unless they have a sale or return policy, then you are protected only by the Distance Selling Regulations. For a full refund of unwanted goods you must tell the seller that you don't want them within 7 days of receipt. If you haven't done this, you must pay for the goods (unless faulty of course). It's nothing to do with them whether you've sold them on or not - they're perfectly entitled to full payment.

    Did you have some written agreement along the lines of "I'll sell these for you and if I don't within <specified timescale>, you'll take the books etc. back and not charge me"? If not, then you have no redress and must pay for the goods.

    You have been advised about the Distance Selling Regulations. You've also been advised to check the terms and conditions which may benefit you.

    AS far as I know, the DSR's don't apply to goods for resale. If you intended to return any unsold goods, then you should have got an agreement in writing that they would supply you on a sale or return basis. If you bought as a retail customer and took a chance on being able to resell quickly then didn't advise of your intention to return within 7 days then you're out of luck I'm afraid.

    A very good point from Queenie.
    Even if the OP was within the 7 day period for the DSR's, this would probably class as a business transaction so wouldn't be covered anyway.

    You don't need to be a legal expert to know how the law stands in the UK.
    Unless goods are faulty or not as described then no retailer legally has to give you the option to return unwanted goods unless the sale falls under the requirements of the distance selling regulations.

    It looks like STL won't accept the return.
    4. RETURNS
    All goods are supplied on a firm sale basis unless a prior agreement has been made with Trust Media Distribution Customer Services.

    On the plus side though OP, you have learnt a very valuable lesson- when starting a new business, it is very unwise to buy stock on credit!
    (As it 'appens, I do have some expertise, having run a successful mail order business for a little over 6 years).
