UPDATED-buyer opened dispute I WON EBAY APPEAL

    Still waiting for the buyer to return the items. I escalated it with ebay who said they would tell the buyer that he had until 05.09.11 to return the items otherwise they would close the case in my favour. :cool:

    Heres an update

    Buyer finally returns item which was received today but only returns 1 of the 6 items sold in the bundle and wait for it!!!!...... the item he has returned is not the same item as sold to him (just like I thought he might do). Its in a poor condition and has a different serial number to the one I sold. The one I sold was in great condition and was unmarked. The one he retuned is scuffed, marked and has marker pen digits written on it. He ended the listing of the one he was selling as faulty on the day he posted it to me.

    Luckily I had listed the bundle with a photo which showed the serial number of the items sold so Im glad I did that.

    I spoke to ebay cs who said they would escatlate the matter with the buyer and request that he returns all the items (including the one he has swapped) within 10 days.

    Talk about defrauding!!

    Lets see what happens now.

    OP Did your buyer put in an ebay or paypal claim? I'm thinking must of been ebay. With paypal I suspect he would have already had his money back.

    he had put in an ebay claim.

    Well ebay without even waiting to see if the buyer had returned all 6 original items went adhead and refunded the buyer the full amount of £520. Luckliy I had asked my bank not to authorise any payments to ebay/paypal until dispute resolved and have also removed my back up payment source from my paypal account do even though ebay has refunded the buyer, they have not been able to take any money from my accounts.

    Ebay told me that they would email the buyer and insist he return all 6 original items and said that they would give him 10 days but lied about that as they had refunede him anyway 5 days after I reported to them that the 1 out 6 items returned was not the original item.

    Ebay response is that I reported this to them via resolution centre (AGAIN!!!), which I have and then I receive another email from them saying that they require me to report this matter to the police and obtain from them a written report on headed paper and email this to them within 10 days.

    This is a load of crap>>>

    My local police have said that is is not necessary to have a written proof I have reported this as the incident number should suffice. The police also said that they have many complaints of a simula nature about buyers who scam refunds like this.

    I have emailed the incident number, telephone number to ebay.

    Its a disgrace that ebay has actual helped the buyer obtain a refund by deception but not listening to the seller and automatically siding with the buyer without investigating the matter thoroughly.
  • I am afraid this is just another incident which proves that Ebay help on the phones say absolutely anything to get rid of you.

    bindiboo, you must continue to fight this otherwise ebay will come after you for the money. I would ring them with the incident number as their email is even worse.

    though i would update this thread....

    After numerous emails, phone calls to ebay resolution/customer services and holding my ground, the final outcome is that I won the appeal after getting a signed report from the police. I had to print off a blank form, which I filled in and my local police station signed it and stamped it, without even reading it.

    The scumbag buyer got his refund but I dont have to reiemburse ebay as they are the ones that refunded him without him sending all the goods back. The buyer has even listed my items for sale on ebay after getting a refund by disception but thats up to Ebay to pursue.....

    Now the question is do I trust using ebay ever again. Good job there is Amazon!
