First Direct PPI refund

I am hoping someone can give me some advise (Sorry this is going to be a bit long)

I rang First Direct back in May to ask about PPI refund on my (many:eek:) accounts, I received the usual 'we are looking in to it' letters and finally last week I received a letter with an offer.

Felix Loan

Offer of £100 ex-gratia payment as they have no statements to review - I think I am going to accept this as this account was only open for a very short time.

Credit card accounts

Card 1: I have been offered £100 ex-gratia payment as they have no statements to review
Card 2 & 3: No offer of any refund as I signed to say I wanted the PPI

I rang them last week to query the 2 cards that they have refused any refund stating my reason again for my complaint - That I was told I had to have the PPI to be able to have the card and that I also asked for the PPI to be removed in order to make my payments less but I was told that I couldn't.

Today I have received their 'Final Response' which is repeating what they said in the original letter, "stating that I had ticked the box and that there was no verbal dialogue between myself and them prior to me returning the application". Enclosed with the letter are copies of the 2 credit card agreements on both copies the no box has been ticked and crossed out and the yes box is ticked.

My questions are - Is it worth me taking this further?
Do I accept the £100 for Card 1?

I am still waiting for their response regarding the loan(s) I had with them, I have been promised that I will hear from them by 31st August but most likely earlier.

    Do I accept the £100 for Card 1?

    If you turned down their offer and referred it to the FOS it would cost them £500 in case fees whether you won or lost. Anything under £500 is a result for them so if you are inclined to accept a 'goodwill gesture' then I would go back to them and propose a higher figure nearer to the £500 FOS fee.
    Its amazing how these banks can't even do simple calculations correctly..............

    Thank you for your reply, I have already declined the £100 offer once and they have written back with the same offer but stating that this is their final offer :(
    Do I go to the FOS?

    If you do go to the FOS, then be prepared to wait a very long time. And there's always the chance that the FOS might agree with the size of First Direct's offer.

    Here are 2 reasons why. They are taken directly from the FOS handbook telling firms how they should deal with claims. They have to investigate the whole claim and sales practice and cant throw a claims out just because you ticked a box on the pre sale agreement or cancel it within the cooling off period. Quote this back to the firm and tell them to refer to the FOS guidelines other wise you will be forced to go via the FOS. I am sure they would take a dim view of there reasons for not upholding.

    2.3.6 G The firm should not reject a complainant’s account of events solely on the basis that the complainant signed relevant documentation regulating the purchase of the policy.

    2.3.7 G The firm should not reject a complaint because the complainant failed to
    exercise the right to cancel.

    Yep this is from the final handbook they published. Have a look at appendix 3 on this link. You might pick out some other points to throw back

    Lets start with a recap of why you are not happy with PPI. What reasons did you give to them. This should have been completed on the FOS forms sent in to them.
