New contract, charged before got the phone!

Being trivial but.
Just taken the nokia n8 offer with o2 that was on over the weekend with the £101 cashback deal(not tracked). Ordered sunday night and got an email today to say that my first bill is online. On 16 they have charged me 52p(data, texts, calls, vat) and the line rental of £16.50 starts on the 17th(today). Thing is i haven't even received the phone yet so how can they charge me for the 16th?
Not sure as it is that i've gone for the right deal, took it as it had the great cashback but that hasn't tracked yet and i've now seen a better deal through talk mobile. Can you return the phone?

    They start charging you from the time of connection.
    The retailer seems to have connected you before sending.
    If you don't use the phone and the services you can return within 7 days under DSR. Some retailers and networks give you even more time, 14 days. You should have checked this before ordering, especially if you were not sure.

    Yes, under Distance Selling Regulations you can. Also check O2's own web site to see if they give you even longer.

    When phone arrives, get some proof of delivery date so that you can reclaim daily rate from them until delivery.

    Also suggest you ring O2 today, tell them that you have not received phone, are unhappy about being charged in advance of receipt and that you want to cancel. Get them to note the call.

    Also suggest you research best deals before ordering next time as changing your mind because you see a better deal a day later inevitably costs the network money and they inevitably pass that on to customers.

  • o2 give you 14 days. Will probably keep just bit niffed that i was charged before receiving even if it is only 52p. The phone is coming by courier and was dispatched yesterday(16th) for next day delivery(today) so theres no way i could have received it yesterday. They couldn't even say it was sent the day before even if they dispatch on a sunday as i didn't order it until 11.30pm.
