Help! Undeclared points on insurance :(

    It could be invalidated if they don't insure people with 6 points (or don't accept this was unintentional).

    However this won't affect your claim if you make it against the third party directly.

    The invalidation possibility is what worries me :( the claim is only for cosmetic damages really, the car can be driven fine. I don't even mind paying for everything, but I know if we get refused insurance it'll just haunt us :(

    Your insurance status will be irrelevant to the third party insurer. If the third party is 100% liable then their insurer will pay everything, no questions asked!

    (And you offering to pay for everything won't make any difference to the outcome of your insurers investigation!)

    I mean I'm prepared to pay for the claim, the backdated money we should have paid, all of it... I'm hoping they'll show some leniency because of that, my partner just got a job as a delivery driver literally a week ago so problems with our insurance, especially if it leads to points, are a big problem :(

    I just can't believe I made such a stupid mistake. I guess it's good it was caught now instead of potentially meaning us backdating years of underpayment but still, I'm so worried they'll be harsh and declare the policy void :( I was just hoping someone could say whether insurance companies will generally accept a back payment instead of invalidating it entirely, especially since we've only had a policy with them for less than a year.

    The point about you being prepared to pay for the claim is that in your OP you said you are "not liable" for the damage.

    If that is the case (assuming the third party who caused the crash has been identified and has insurance) then your insurer won't be paying for the claim anyway!

    As previously posted their decision will be based on whether they would have insured your partner if they had known he had a conviction for driving without insurance, and if so, whether they regard his failure to declare this as an innocent mistake.

    If they do, then the least "penalty" you will face will be paying the correct premium for the year probably with an admin fee for a mid term change to your details.

    Oh, I see what you mean! I didn't know that. That's good to know then, at least we could still get the car fixed.

    I hope this is the case, I would never have put through the wrong quote on purpose, it's my fault for not checking which one was right and just assuming :( the girl on the phone was really nice about it at least, I was nervous before I called that they'd be really horrible about it.

    I know life goes on but we're in this awful pit at the moment, every time something good happens, something bad seems to pop up to ruin it.

    If the worst happens and the claim you have made is rejected by your insurer, then you will still be able to get the car fixed by going to the third party's insurer direct and making your claim with them.

    I guess they will still have both quotes recorded.

    Worst case scenario, they think you tried two quotes and decided to accept the cheaper one deliberately.

    Best case scenario, they accept that you were just trying to find out the effect of the points and made a simple mistake and charge you the extra premium.

    The fact that he admitted the points now should help - if you were trying to deceive them he could've kept quiet about them now too.

    Insurers tend to naturally take a dim view of points for uninsured driving so hopefully the circumstances of the conviction will be a mitigating factor and can be explained to them if need be.

    I would suggest you stay calm when you talk to them but make it clear that this is very worrying for you.
    Remember, if their initial reaction is negative you can still refer it higher.

    You mention your OH has just got a job as a delivery driver and this will affect things if there are problems with your insurance. How exactly? Is he using your vehicle for doing deliveries?

    If so this needs to be declared to underwriters otherwise he won't be covered.

    If he is using an employer's vehicle then he should have already declared his points.
