Exactly, so I don't know how they're working this one out but I'm going to push this further than just a refund, after 4 responses, each one a different excuse as to why it can't be returned (and the latter being completely absurd), I think a complaint is in order.

Indeed, this reflects very badly on Overclockers. They think that by giving customers misleading info - repeatedly - about their rights they are being clever and saving themselves money by not having to handle a return.

But several hundred people have seen this thread already, and most will be thinking the same thing - never, ever buy from a company that treats its customers like that.

Overclockers review customer feedback customer service are all words that might help potential customers find this thread.

For what its worth Overclockers customer service has been improving over the years, but as said they did have a VERY bad reputation. A woman on here got a very good result with them a few weeks ago regarding a damaged PC.
Ive spent £1000's with Overclockers and never had a problem myself.

I'd bet most large retailers would have gone bust if they actually followed the DSR and the SOGA to the letter.

Overrclockers should look at all the correspondence and then Overclockers should arrive at the only decision. The, Overclockers, have been more than devious and tried to avoid responsibility. I certainly wouldn't buy from them!

As I mentioned earlier, I sent off an email requesting a refund under the sale of goods act AND a complaint. I've had a reply regarding the former -
    Dear Stephen Donaghy,

Well we will have to test this for you under an RMA. If the item is faulty then we can refund it or replace for you?

    Regards,

    James Bailey

Part of the reason I didn't want to go down this route (and particularly with how reluctant they are to have the thing returned) is because the fault is somewhat debatable - the trackpad generally works if you tap it pretty hard, but in "normal" use it's pretty unresponsive (and this is with sensitivity set to the maximum). It's the same with the buttons on the trackpad, you have to press them pretty hard and in the right spot to get them to reliably work. If they say it's not faulty, it becomes a whole new argument and I'll have to play the other cards - not satisfactory quality/not fit for intended purpose, which are even more debatable and the whole issue becomes a long drawn out one. I'm not giving up though. I'll give them until tomorrow morning to respond to the complaint and then I'll assess my options.

At the moment, I'm tempted to take them to small claims over their complete disregard for the distance selling regulations and blatant lies.

Is this a generic problem with this model, i.e. a manufacturing fault? If other users have the same issue, that adds strength to your case for rejecting it as unfit for purpose.

It's not so much a manufacturing fault as just poorly manufactured. If you Google around regarding Sentelic trackpads, most people moan that it doesn't support slide-scrolling and quite a few people mention the otherwise poor usability of them. I can't find many that are having the exact issue as myself, but considering that the general consensus is that they're of poor quality, I assume it's the same.
