Disabled Bay Private Car Park

Had a barney today, i had to go to a meeting, the building which is private land has limited parking, I am disabled with limited mobility so parked in a disabled bay, but don't have a blue badge., part way through the meeting the building concierge who knows i am disabled put one of those "Baywatch" notices on my windscreen.

I went out and saw there were now a couple of free visitor spaces, so said i would move the motor into one of the now empty bays. He says it is too late "I have broken the Law". I said that the BB scheme doesn't apply on private land, and that under the Equalities Act I was entitled to park there anyway. He retorted that no I "had broken the law" and as I had been abusive by trying to point out what the law actually is even though I would move the motor he was going to have it towed away.

I told him that I would be sending a letter before action to the management agents for the site, pointing out they are in breach of the Equalities Act by their treatment of myself by their employee.

Thoughts please as to whether this would be a suitable course of action?

    You had a right to park in the disabled bays because you fit the definition of disabled, the Blue Badge scheme doesn't apply on private land and if landowners only allow disabled motorists whom have a blue badge they are breaking the Equalities Act.

    If they start harassing you with made-up invoices sue the landowner for harassment, it's going to happen one day.

    I won't get an unenforceable invoice, I will get a lot of grief as he has made an official complaint to the company I was in a meeting with who are tenants in the building, for my abusing him and my "illegal parking" he knows i am disabled and i have had problems there before but he is adamant, no badgee no parkee, i would not use a disabled bay normally, but as there was nowhere else....... but he is a complete jobsworth who swears blind that it is the LAW that you need a blue badge to use ANY disabled bay period, and he was going to have my motor towed away. I said i will move it off the premises then, he said your banned from the building then for abuse, he was not going to let me stay on the premises and escorted me from the building.

    I am considering which sections of the Act to quote in my letter, I am not interested in compensation, just an acknowledgement that they were wrong

    Who says so, what legislation says it is compulsory for a disabled person to have a blue badge? Please provide Statute, references and applicable caselaw to back your statement. The scheme is an indicator, and a concession but it is not enforceable on Private Land, merely advisory

    PPC rules mean nothing when compared to the law - you know, a proper law about disability discrimination.

    The blue badge scheme does NOT apply on PRIVATE land.

    The poster has obviously been brainwashed by Mobilise or whatever they call themselves this week...

    I don't condone misuse of bays, and only use them if it is an absolute neccessity, I suppose I'd better apply for a new badge then, as I didn't bother to renew it

    Independent Enforcement Agencies uphold decency in private car parks, and they must do so in an even fashion.

    Bless you, I've heard Job-Seekers allowance is going up soon when you sign onto the dole when your money making scam collapses.

    I just hope it's one of your car-parks which takes taken to court and has to pay out thousands when you try and sue a disabled person for damages when they park in a disabled bay and not display a meaningless (on private land) blue piece of card

    Yes they are there for a reason, but it doesn't alter the fact that enforcement of blue badges, by invoice clamping or towing in a private car park, where they are not a LEGAL requirement against a person classed as disabled within the meaning of the act is of itself unlawful.

    now I could argue semantics with you all night but unless you can provide details of which Statutes, and which sections of these Acts you are basing your statements, along with any case law to support your viewpoint, I am not going to respond to you further.
