iphone apps & distance selling regs

Options
Hi,
I've purchased numerous crap Apps over the years. As usual the advertising blurb gushes about the Apps virtues, but the reality is an altogether different matter.

Is there a way to get a refund on the App. Amazon provide a 7 day refund service for Kindle content.

Well not sure why you see 250000 apps, when more than 249900 are likely to be rubbish, they have reviews for the apps and trial editions, next time look twice buy once.

    Don't know about iP, but
You have 15 minutes from the time of download to return an application purchased through Android Market for a full refund. You may only return a given application once; if you subsequently purchase the same app again, you may not return it a second time.
DSR are very vague about software and outdated. They exclude 'unsealed' software from returns.

In Taiwan, Apple recently had to allow 7 day refunds after a court ruled that they had to follow their laws for distance selling, I think they were fined there too if I remember right. http://www.wired.co.uk/news/archive/2011-07/18/taiwan-app-store-refunds So it is only a matter of time before distance selling rules bite the itunes and android market unless they get special exemptions. Just my thoughts on this. This is only regarding apps, I dont know what rules apply for music bought online.

Wonder when the UK authorities will enforce distance selling laws of the UK just like they are enforced in Taiwan.

I was always under the impression an app was software or a service so once used, exempt from DSR. The DSR is clear on this so there is no confusion.

Do downloads of electronic books or music from a website,
or the purchase of ring tones and screen savers for mobile
phones fall within the cancellation exceptions referred
    to above?
3.39 We consider that these examples are likely to constitute services,
rather than goods as the consumer does not receive physical goods.
The right to cancel are therefore those that apply to services.

No. DSR does not apply to non-physical goods or software.
